How is Carrying Documents and State Secret Containers Out of the Storage Place Regulated?
According to the provisions set forth in Article 5 of Decree 26/2020/ND-CP, which came into effect on July 1, 2020, the regulations on bringing documents and items containing state secrets out of the storage locations are as follows:
Individuals bringing documents and items containing state secrets out of storage locations for domestic or international work purposes must have a written permission from the competent authority as stipulated in Clause 1, Clause 2 of Article 14 of the Law on Protection of State Secrets. Upon completing the mission, they must report to the competent authority that granted permission regarding the management and use of state secrets and return the documents and items containing state secrets to the agencies or organizations.
The written permission to bring documents and items containing state secrets out of storage locations for domestic or international work purposes must clearly state the name, position, and working unit of the individual; the type, abstract content, and level of secrecy of the documents and items containing state secrets; the purpose of use; the time and place of the work; and the measures for protecting state secrets.
Documents and items containing state secrets taken out of storage locations must be contained, stored, and transported using safe means and equipment as prescribed by the head of the agency or organization directly managing the state secrets, and must be protected during the time they are out of storage locations.
