How does the Court handle petitions, proposals, reflections, and requests containing denunciations under the new regulations?
Pursuant to Article 26 of Circular 01/2020/TT-TANDTC (effective August 10, 2020) stipulating the receipt and handling of petitions, proposals, requests, or complaints with denunciation content by the Court as follows:
- Petitions, complaints, proposals, requests with denunciation content that fall under the jurisdiction of the People's Court shall be processed by the handler who proposes the competent authority to resolve as prescribed;
- In cases where petitions, complaints, proposals, requests do not contain denunciation content or contain denunciation content but do not fall under the jurisdiction of the People's Court, the handler shall propose the competent authority to return the petition to the sender or forward the petition to the competent authority, organization, or individual for resolution as prescribed, and notify the sender of the reasons for not handling the case.
