How Are Officials Who Apply Incorrect Punishment Measures Disciplinarily Handled?
Based on Clause 1, Article 25 of Decree 19/2020/ND-CP (Effective from July 1, 2020) which stipulates that the disciplinary form of reprimand shall be applied to officials who commit one of the following violations in the enforcement of the law on handling administrative violations:
- Failure to impose administrative penalties, failure to apply remedial measures, or failure to impose administrative measures on violators according to the law;
- Applying the form of punishment, the level of punishment, and the remedial measures incorrectly and incompletely for administrative violations;
- Prolonging the deadline for applying administrative measures;
- Illegally interfering in the handling of administrative violations;
- Illegally interfering in the inspection activities, taking advantage of their influence to affect the person performing the inspection duties;
- Providing inaccurate and dishonest information and documents related to the inspection content;
- Lacking responsibility in directing the implementation of the inspection conclusions.
=> Therefore, if the competent officials impose improper disciplinary forms, a reprimand disciplinary form shall be applied.
