How are enforcement measures for remedying consequences in the field of fire prevention, fighting, and rescue regulated?

Enforcement of Measures to Remedy Consequences in the Field of Fire Prevention and Fighting (FPF), Rescue, and Salvage

According to Clause 5, Article 16 of Circular 06/2022/TT-BCA, the regulations on enforcement of measures to remedy consequences in the field of fire prevention and fighting, rescue, and salvage are as follows:

  1. For measures to enforce the implementation of remedies for the consequences as stipulated in point d, clause 2, Article 86 of the Law on Handling Administrative Violations of 2012, amended and supplemented in 2020, the implementation is as follows:

a) Draft the Enforcement Order to Implement the Remedy Measures according to Decision Form No. 11 issued along with Decree No. 118/2021/ND-CP and the notice document about the time and place of the enforcement, request the commune-level People's Committee (where the enforcement is organized) to assign representatives to participate, report to direct leaders and commanders for approval and signing by the competent authority;

The signing dossier components are regulated at points a, e, g, and h in item 9 of the Appendix listing dossier components issued along with this Circular;

b) After the Enforcement Order and notice document are approved and signed: Implement the numbering and stamping according to regulations;

c) Send the Enforcement Order to the individuals and organizations subject to enforcement and related individuals and organizations according to Article 5 of Decree No. 166/2013/ND-CP and the notice document to the commune-level People's Committee (where the enforcement is organized) according to regulations;

d) Organize the enforcement according to Articles 34 and 35 of Decree No. 166/2013/ND-CP. The result of the enforcement is recorded in Form No. 11 issued along with Decree No. 118/2021/ND-CP.

Dossier for Enforcement of Decision on Administrative Penalties in the Field of Fire Prevention and Fighting, Rescue, and Salvage

According to Clause 6, Article 16 of Circular 06/2022/TT-BCA, the regulations on the dossier for enforcement of the decision on administrative penalties in the field of fire prevention and fighting, rescue, and salvage are as follows:

  1. The dossier for enforcement of the decision on administrative penalties in the field of fire prevention and fighting, rescue, and salvage is a component of the administrative penalty dossier in the field of fire prevention and fighting, rescue, and salvage and is prepared and stored according to the regulations on the operational dossier of the People's Public Security.
