How are Annual Leave Days for the People's Public Security Forces Regulated?

According to legal regulations, how are the annual leave days for the People's Public Security defined? Thank you.

Clause 1, Article 40 of the Law on People’s Public Security 2018 stipulates that officers, non-commissioned officers, soldiers, and police workers currently working are entitled to rest according to the provisions of the Labor Code and the regulations of the Minister of Public Security.

In addition, Article 111 of the Labor Code 2012 stipulates the following regarding annual leave days:

  1. Employees who have worked for a full 12 months for an employer are entitled to annual leave with full pay as per the labor contract as follows:

a) 12 working days for employees doing normal work;

b) 14 working days for employees doing heavy, hazardous, dangerous work or for those working in areas with extremely harsh living conditions according to the list promulgated by the Ministry of Labor, War Invalids and Social Affairs in cooperation with the Ministry of Health, or for juvenile workers or workers with disabilities;

c) 16 working days for employees doing particularly heavy, hazardous, dangerous work or for those working in areas with especially harsh living conditions according to the list promulgated by the Ministry of Labor, War Invalids and Social Affairs in cooperation with the Ministry of Health.

  1. Employers have the right to set the annual leave schedule after consulting with the employees and must notify the employees in advance.

  2. Employees may reach an agreement with employers to take annual leave in multiple times or accumulate such leave over a maximum of 03 years.

  3. When taking annual leave, if employees travel by road, rail, or water and the total traveling time both to and from exceeds 02 days, the additional travel time from the 3rd day onwards shall be added to the annual leave and be counted for only one trip per year.

Article 112 of the Labor Code 2012 stipulates that annual leave increases based on seniority as follows: For every 05 years of work for an employer, the employee’s annual leave under Clause 1, Article 111 of this Code shall be increased by 01 day.

From the above analysis, upon entering the sector and completing 12 months of work, you will be entitled to 12 days of annual leave as stipulated by the Labor Code. For every 5 years of work in the sector, you will receive an additional 1 day of annual leave, not depending on your rank.

Having worked for:

- From 5 years to less than 10 years: an additional 1 day- From 10 years to less than 15 years: an additional 2 days- From 15 years to less than 20 years: an additional 3 days- From 20 years to less than 25 years: an additional 4 days- From 25 years to less than 30 years: an additional 5 days- From 30 years to less than 35 years: an additional 6 days- From 35 years and over: an additional 7 days
