Has the Report No. 219 in 2025 on supplementation and completion of the Plan for restructuring and streamlining the organizational structure of the Government of Vietnam been issued?
On January 11, 2025, the Ministry of Home Affairs issued Report 219/BC-BNV in 2025 to supplement and complete the plan for restructuring and streamlining the organizational structure of the Government of Vietnam.
Pursuant to Section 1 of Report 219/BC-BNV in 2025 regarding the naming of Ministries, ministerial-level agencies, and agencies affiliated with the Government of Vietnam:
- Ministry of Finance after the merger of the Ministry of Planning and Investment and the Ministry of Finance
- Ministry of Home Affairs after the merger of the Ministry of Labor, Invalids and Social Affairs and the Ministry of Home Affairs
- Ministry of Construction after the merger of the Ministry of Transport and the Ministry of Construction
- Ministry of Science and Technology after the merger of the Ministry of Information and Communications and the Ministry of Science and Technology
- Ministry of Culture, Sports, and Tourism after taking over the state management function over journalism from the Ministry of Information and Communications.
- Establishing the Ministry of Ethnic and Religious Affairs based on the Committee for Ethnic Affairs receiving additional functions, tasks, and the state management apparatus on religion from the Ministry of Home Affairs.
- Other ministries and sectors continue to retain the names as proposed in Report No. 3792-BC/BCSĐCP dated December 31, 2024, of the Party’s Committee of the Government of Vietnam, specifically:

What are regulations on the organizational structure of the Ministries of Vietnam?
Based on Article 17 of Decree 123/2016/ND-CP regulating the organizational structure of the Ministry:
Article 17. Organizational Structure of the Ministry
- The organizational structure of the Ministry includes:
a) Department;
b) Office;
c) Inspectorate;
d) Directorate (if any);
dd) General Department (if any);
e) Public service unit.
- The public service providers are regulated by the Decree prescribing the functions, tasks, powers, and organizational structures of each Ministry, including:
a) Units for strategic and policy research on sectors and fields;
b) Newspaper, magazine; Information center;
c) School or center for training and retraining of officials and public employees; Academy affiliated with the Ministry.
- The number of deputy heads of offices, inspectorates, departments, directorates, general departments, public service providers perform according to the regulations of the Law on Organization of the Government of Vietnam.
The organizational structure of the Ministry is as follows:
- Department
- Office
- Inspectorate
- Directorate (if any)
- General Department (if any)
- Public service unit
What are the duties and powers of the Ministry regarding legal affairs in Vietnam?
Based on Article 6 of Decree 123/2016/ND-CP regulating the duties and powers of the Ministry regarding legal affairs:
- Submit to the Government of Vietnam draft laws and draft resolutions of the National Assembly; draft ordinances, draft resolutions of the Standing Committee of the National Assembly; draft decrees of the Government of Vietnam according to the annual legislative building program and plan of the Government of Vietnam and the resolutions, projects, schemes as assigned by the Government of Vietnam, Prime Minister of the Government of Vietnam.
- Submit to the Government of Vietnam opinions on draft laws and ordinances submitted by agencies, organizations, National Assembly deputies that have relevance to the sectors or fields under the management of the Ministry.
- Submit to the Government of Vietnam decisions on measures to enforce the Constitution, laws, resolutions of the National Assembly, ordinances, resolutions of the Standing Committee of the National Assembly, orders, decisions of the President as assigned by the Government of Vietnam, Prime Minister of the Government of Vietnam.
- Submit drafts of decisions, directives, and other documents to the Prime Minister of the Government of Vietnam as assigned.
- Issue circulars and other documents on state management for sectors, fields under the state management of the Ministry; guide and inspect the implementation of these documents.
- Issue inter-ministerial circulars with the Chief Justice of the Supreme People's Court, the Chief Prosecutor of the Supreme People's Procuracy to regulate coordination between the Ministry with the Supreme People's Court, the Supreme People's Procuracy in implementing procedures, prosecutorial proceedings related to the scope of state management of the Ministry.
- Direct and organize the implementation of propaganda, dissemination, education of law under the state management of the Ministry.
- Inspect legislative documents issued by Ministries, People's Councils, People's Committees of provinces, centrally-run cities related to sectors and fields under the state management of the Ministry; if it finds that regulations issued by these agencies have signs of being contrary to the legislative documents in the sectors, fields managed by the Ministry, it shall recommend handling according to the law.
