Has the Father Worked for the Old Policies, Can the Child Register for Military Service?
If my father worked for the former regime, can I register for military service?
According to Article 13 of the 2015 Law on Military Service, there are provisions regarding individuals who are not eligible to register for military service as follows:
- Citizens who fall into one of the following categories are not eligible to register for military service:
a) Under criminal prosecution; serving a prison sentence, non-custodial reform, house arrest, or having completed a prison sentence but not yet had their criminal record cleared;
b) Subject to educational measures at the commune, ward, or commune-level town (hereinafter collectively referred to as commune-level) or placed in reformatory schools, compulsory educational institutions, or compulsory rehabilitation centers;
c) Deprived of the right to serve in the People's Armed Forces.
- When the duration of the measures specified in clause 1 of this Article expires, citizens are eligible to register for military service.
Based on the current regulations, if your father worked for the former regime, this issue does not affect your ability to register for military service. Therefore, you can fully register for military service.
Which authority has the jurisdiction to register military service?
According to Article 15 of the 2015 Law on Military Service, there are provisions regarding the authority competent to register for military service as follows:
The Military Command Board at the commune level shall perform military service registration for citizens residing in the locality.
The Military Command Board at agencies and organizations at the grassroots level shall perform military service registration for citizens working, studying at agencies and organizations, and compile reports to the Military Command Board at the district, district-level town, and city under the province and equivalent administrative units (hereinafter collectively referred to as district level) where the agencies and organizations are based; if the agencies and organizations do not have a Military Command Board at the grassroots level, the head or legal representative of the agencies and organizations shall be responsible for organizing the citizens to register for military service at their place of residence.
** Depending on specific circumstances, the Military Command Board at the commune level or the Military Command Board at agencies and organizations at the grassroots level will have the authority to register for military service.**
