Graduated from High School, participated in military service, admitted to the Communist Party, can return to the locality to become an official?
According to Clause 1, Article 1 of the Law on Cadres, Officials, and the amended Law on Public Employees 2019:
Officials are Vietnamese citizens, recruited, and appointed to ranks, positions, and titles corresponding to job positions in agencies of the Communist Party of Vietnam, the State, socio-political organizations at the central, provincial, and district levels; in agencies and units under the People's Army that are not officers, professional soldiers, or defense workers; in agencies and units under the People's Police that are not officers, non-commissioned officers serving under professional policies, police workers, on the payroll and receive salaries from the state budget.
If you want to become an official at the commune or ward level, you must be recruited and appointed to ranks, positions, and titles corresponding to job positions in the agencies as prescribed.
The recruitment of officials must be based on the requirements of tasks, job positions, and staffing quotas of the official-using agency (Clause 1, Article 3 of Decree 24/2010/ND-CP).
In summary, you can only apply for the official recruitment if the commune or ward is recruiting.
Conditions for recruitment registration (Clause 1, Article 36 of the Law on Cadres, Officials 2008):
- Having Vietnamese nationality;
- Being 18 years of age or older;
- Having an application for recruitment; having a clear background;
- Having appropriate diplomas and certificates;
- Having good political and ethical qualities;
- Having enough health to perform tasks;
- Other conditions as required by the recruitment position.
Participating in military service is only a priority condition when registering for the official recruitment according to Clause 2, Article 1 of Decree 161/2018/ND-CP. As for joining the Communist Party, it is not a priority condition but may fall under other conditions as required by the recruitment position.
