Examining Body Marks on Traffic Accident Victims: What Are the Regulations?
Considering the examination of traces on the body of a traffic accident victim as stipulated in Clause 1, Article 15 of Circular 63/2020/TT-BCA. To be specific:
Besides implementing the regulations at Articles 9, 10, 11, 12, 13, 14, and 16 of this Circular; depending on the nature and extent of each traffic accident, when conducting the investigation, verification, and resolution, the following activities must be carried out:
- Examining traces on the body of the victim:
a) Examining traces on the body of the victim must obtain the consent of the victim and be meticulously recorded; specifically and in detail described in the Record of Traces on the Body of the Victim according to Form 11/TNDB issued under this Circular. Mark the location of the injuries on the Diagram of Traces on the Body of the Victim according to Form 12/TNDB issued under this Circular, and take photographs of the injury traces. If the victim is female, a female officer must be appointed to participate in the examination of the injury traces, and a same-gender witness must be present;
b) If the victim is taken to the emergency room, it is necessary to collect the injury certificate, the medical records of injury treatment caused by the accident, or the results of the medical assessment of the body injury rate;
c) If the victim does not go to the emergency room but requests an assessment of the body injury rate, the provisions at point a of this clause must be implemented and report to the competent leadership for request or recommended to the competent assessment agency according to the provisions of the law.
