Election of Vote-Counting Committee for People's Councils at All Levels for the 2021-2026 Term: What Are the Regulations?
Election of the Vote Counting Committee for the People's Councils at all levels for the term 2021-2026 is stipulated in Section 5 of Guidance 883/HD-UBTVQH14 2021 organizing the first meeting of the People's Council for the term 2021-2026. To be specific:
- Election of the Vote Counting Committee:
The presiding chairperson of the meeting introduces the personnel for the People's Council to elect the vote counting committee. The provincial-level People's Council shall elect a Vote Counting Committee with at least 07 members; the district level shall have at least 05 members and the commune level shall have at least 03 members. The Vote Counting Committee includes a Head, a Secretary, and committee members who are deputies of the People's Council for the term 2021-2026. The Vote Counting Committee is elected once and performs vote counting in all secret ballots during the People's Council meeting. The maximum number of members of the Vote Counting Committee is determined by the People's Council based on the number of deputies to ensure that the vote counting is quick and efficient.
Individuals listed for election by the People's Council shall not serve as members of the Vote Counting Committee. In the event that a member of the Vote Counting Committee needs to be replaced, the People's Council shall decide on the replacement and supplement of the Vote Counting Committee members as proposed by the chairperson of the meeting.
The Vote Counting Committee is responsible for disseminating, guiding the procedures, and the process of voting, vote counting, and announcing the vote-counting results for contents subject to the People's Council's secret ballots. The Vote Counting Committee's duties conclude once all vote-counting tasks at the meeting are completed.
- The Vote Counting Committee determines the election results of the People's Council according to the following principles:
+ The person who receives more than half of the valid votes compared to the total number of the People's Council deputies and has the most votes shall be elected;
+ In the event that multiple individuals are elected to the same position with the same number of votes and each receives more than half of the total number of People's Council deputies, a re-election for this position among the individuals with the highest equal votes shall be conducted by the People's Council. Among those re-elected, the individual with the higher number of votes shall be elected; if re-election results in a tie again, the older individual shall be elected.
