Duties and Responsibilities of Officers, Non-commissioned Officers, and Soldiers of the People's Public Security Force according to the New Law
On November 20, 2018, the National Assembly of the Socialist Republic of Vietnam, term XIV, during its sixth session, passed the Law on People's Public Security No. 37/2018/QH14 (referred to as the Law on People's Public Security 2018).
The Law on People's Public Security 2018 stipulates principles of organization and activities; position, functions, tasks, and powers; ensuring operational conditions; policies towards the People's Public Security; and the responsibilities of related agencies, organizations, and individuals.
According to the provisions of Article 31 of the Law on People's Public Security 2018 (effective from July 1, 2019), the obligations and responsibilities of officers, non-commissioned officers, and soldiers in the People's Public Security are specifically regulated as follows:
- Absolutely loyal to the Fatherland, the People, the Communist Party, and the State.
- Strictly comply with the guidelines and policies of the Communist Party, the laws of the State, the regulations of the People's Public Security, and the directives and orders of superiors.
- Be honest, brave, vigilant, ready to fight, and fulfill all assigned tasks.
- Respect and protect the legitimate rights and interests of agencies, organizations, and individuals; closely associate with the People; dedicatedly serve the People; and show respect and courtesy towards the People.
- Regularly study to enhance political, legal, scientific-technical, professional knowledge, and skills; cultivate revolutionary virtues, a sense of organizational discipline, and physical fitness.
- Be responsible before the law and superiors for their own orders, for complying with the orders of superiors, and for the performance of subordinates under their command. When receiving orders from a commander, if there is a basis to believe that the order is unlawful, they must immediately report to the issuer of the order; if still required to comply with the order, they are not held responsible for the consequences of executing that order and must promptly report to the direct superior of the person issuing the order.
