Duties and powers of the One-Stop-Shop Division according to the one-stop-shop mechanism under the Ministry of Home Affairs in Vietnam

Duties of the One-Stop-Shop Division according to the one-stop-shop mechanism under the Ministry of Home Affairs in Vietnam

Pursuant to Article 5 of the Regulation on organization and operation of the One-stop-shop Division under the one-stop-shop mechanism, the one-stop-shop mechanism in handling administrative procedures at the Ministry of Home Affairs promulgated together with Decision 125/QD-BNV in 2022, duties of the One-Stop-Shop Division according to the one-stop-shop mechanism under the Ministry of Home Affairs are as follows:

1. Fully and promptly publicize by electronic means, on the Ministry's Public Service Portal, the National Public Service Portal or in writing the list of administrative procedures to be carried out at the One Window Department; The contents of administrative procedures are publicized according to the provisions of the law on control of administrative procedures and Decree No. 61/2018/ND-CP.

2. Guide the implement administrative procedures; receive and digitize administrative procedures; settle or transfer records for settlement of administrative procedures; return the results of administrative procedures; monitor, supervise and evaluate the settlement and return results of administrative procedure settlement to organizations and citizens; collect fees and charges (if any) according to regulations.

3. Coordinate with relevant agencies and units to settle and return settlement results to organizations and citizens for cases where administrative procedures require settlement within the same day or administrative procedures are approved. assign or authorize civil servants at the One-Stop-shop to handle; support organizations and citizens to use online public services at level 3 and level 4.

4. Coordinate with competent agencies and other relevant agencies in organizing training and retraining to improve professional qualifications for civil servants assigned the task of guiding, receiving and returning results of administrative procedures settlement according to the one-stop-shop,  inter-agency one-stop-shop mechanism.

5. Receive, handle or report to the agency competent to handle complaints, petitions, complaints and denunciations of organizations and citizens about the Ministry of Home Affairs civil servants related to the guidance and reception, settle, transfer the settlement file and return the results of administrative procedures; transfer opinions and explanations of competent agencies on reflections, recommendations, complaints and denunciations to organizations and citizens.

6. The Public Service Portal and the Ministry's electronic one-stop information system are built in a centralized and unified manner, forming the Ministry's information system for handling administrative procedures to receive, handle, monitor, assessing the quality of administrative procedures implementation and online public service provision under the handling competence of the Ministry of Home Affairs.

7. The Ministry's electronic one-stop information system connects and shares data with national databases and specialized databases under its management with the National Public Service Portal in accordance with the law to authenticate information for organizations and citizens and serve the settlement of administrative procedures.

8. The Office of the Ministry of Home Affairs is responsible for synthesizing assessment results from the Ministry's electronic single-window information system; integrate the evaluation results with the quality assessment system of administrative procedure settlement of the National Public Service Portal to serve the direction and control of the quality of administrative procedure settlement, and the provision of public services in real time; publicize the results of the internal assessment on the website of the Ministry of Home Affairs.

9. At the One-Stop Department, an area for information provision and administrative procedures shall be arranged; the area for receiving and returning scientific results, which is reasonable and suitable to professional requirements in receiving dossiers and returning results for settlement of administrative procedures, ensuring convenience for organizations and citizens when they come to transact according to the provisions of Decree No. 61/ND-CP. Encourage the integration of utility services to support and serve the needs of organizations and citizens when they come to transact at the One-Stop Department of the Ministry of Home Affairs.

10. Perform other assigned tasks as prescribed by law.

Powers of the One-Stop-Shop Division according to the one-stop-shop mechanism under the Ministry of Home Affairs in Vietnam

Pursuant to Article 6 of the Regulation on organization and operation of the One-stop-shop Division under the one-stop-shop mechanism, the one-stop-shop mechanism in handling administrative procedures at the Ministry of Home Affairs promulgated together with Decision 125/QD-BNV in 2022, powers of the One-Stop-Shop Division according to the one-stop-shop mechanism under the Ministry of Home Affairs are as follows:

1. Request units under and under the Ministry and relevant agencies and units to provide information and documents in service of receiving and handling administrative procedures.

2. Refuse to accept dossiers that are not in accordance with regulations; assume the prime responsibility for monitoring, supervising and urging relevant agencies and units to handle administrative procedures strictly according to the process approved by competent authorities; request competent agencies and units to provide information on the receipt and progress of administrative procedures by organizations and citizens; urge the units participating in the One-Stop-Shop to handle incoming or overdue dossiers.

3. Monitor, urge, comment and evaluate civil servants sent by units under the Ministry to work in the One-Stop-Shop for the observance of working time and the provisions of the law on public service regimes, regulations on office culture, internal regulations of the agency.

4. Propose the renewal, improvement and improvement of service quality, performing official duties on time and convenient for organizations and citizens; organize or coordinate in organizing information and propagation on the implementation of the one-stop-shop mechanism in handling administrative procedures.

5. Propose competent authorities to upgrade the physical facilities, information infrastructure and application software of the Public Service Portal, the Ministry's electronic one-stop information system; participate in ensuring information security during the exploitation and use of these Systems.

6. Exercise other powers assigned in accordance with law.
