Documentation and Procedures for Recognition and Resolution of Policies for Revolutionaries Imprisoned by Enemy Forces

Based on Article 62 of Decree 131/2021/ND-CP (Effective from February 15, 2022), the regulations on documentation, procedures for recognition, and resolution of policies for revolutionaries imprisoned by enemy forces are as follows:

- Individuals shall prepare a declaration form according to Form No. 10 in Appendix I of this Decree, accompanied by one of the documents specified in Article 60 of this Decree, and submit it to the People's Committee of the commune where they reside.

In the event of death before receiving preferential policies, a death notice or death certificate extract must be included.

- The People's Committee of the commune, within 05 working days from the date of receipt of all documents, is responsible for verifying the declaration form and preparing a list of eligible cases, accompanied by the required documents as stipulated in Clause 1 of this Article, and sending them to the Department of Labor, Invalids and Social Affairs.

- The Department of Labor, Invalids and Social Affairs, within 07 working days from the date of receipt of all documents, is responsible for verifying and preparing a list, including the required documents, and sending it to the Provincial Department of Labor, Invalids and Social Affairs.

- The Provincial Department of Labor, Invalids and Social Affairs, within 12 days from the date of receipt of all documents, is responsible for verifying and issuing a decision of recognition and preferential subsidy according to Form No. 66 in Appendix I of this Decree.

Documentation and Procedures for Recognition in the Case of Active Military Service or Working in the Army

According to Article 63 of Decree 131/2021/ND-CP (Effective from February 15, 2022), the regulations on documentation and procedures for recognition in the case of active military service or working in the army are outlined as follows:

- Individuals shall prepare a declaration form according to Form No. 10 in Appendix I of this Decree, accompanied by one of the documents specified in Article 60 of this Decree, and submit it to the direct managing agency or unit.

- The Ministry of Defense shall guide the recognition process and implement preferential policies for revolutionaries, resistance fighters, defenders of the Fatherland, and international duty missions who were imprisoned by enemy forces while on active military service or working in the army. The time for review and resolution is not more than 30 days from the date of receipt of the declaration form.
