Does the curriculum vitae in the civil servant rank promotion exam application need to be notarized in Vietnam? What are conditions for civil servants to register for the rank promotion exam in Vietnam? 

Hello, currently I am a state civil servant, I plan to take the rank promotion exam, I am preparing my application, the application requires a curriculum vitae, so is this curriculum vitae necessary need to be notarized or not?

Does the curriculum vitae in the civil servant rank promotion exam application need to be notarized in Vietnam?

In Article 36 of Decree 138/2020/ND-CP, regulations on civil servant rank promotion documents are as follows:

1. Documents for civil servant promotion exam:

a) A civil servant curriculum vitae according to current regulations must be prepared no later than 30 days before the deadline for submitting applications for promotion to rank, with confirmation from the agency managing and employing civil servants;

b) Comments and assessments of the head of the agency or organization employing civil servants on the standards and conditions for registering for the exam according to regulations;

c) Copies of diplomas and certificates as required by the exam category;

In cases where civil servants have a professional diploma with standardized output in foreign languages ​​or information technology according to regulations that correspond to the requirements of the exam category, they are not required to submit foreign language or information technology certificates.

In cases where civil servants are exempted from taking foreign language or computer science tests as prescribed in Clauses 6 and 7, Article 37 of this Decree, they are not required to submit foreign language or computer science certificates.

d) Other requirements according to regulations on professional standards of civil servant ranks participating in the exam.

2. Documents for consideration of civil servant rank promotion:

In addition to the provisions in Clause 1 of this Article, the application for civil servant rank promotion consideration also includes copies of documents proving the standards and conditions for civil servant rank promotion consideration specified in Article 31 of this Decree.

Thus, according to the regulations on your curriculum vitae, you only need to have confirmation from the management agency, using civil servants means the agency where you are working. Therefore, you do not need to notarize your curriculum vitae in Vietnam.

What are conditions for civil servants to register for the rank promotion exam in Vietnam? 

Pursuant to Article 30 of Decree 138/2020/ND-CP stipulating bases, principles, standards and conditions for taking the civil servant promotion exam as follows:

1. The promotion of civil servant ranks must be based on the job position and in accordance with the civil servant rank structure of the agency employing civil servants approved by the competent authority.

2. Based on the number of rank promotion quotas of agencies and organizations employing civil servants approved by competent authorities, the civil servant management agency is responsible for reviewing, determining and making a list of civil servants. have enough standards and conditions to take the rank promotion exam.

3. Civil servants can register to take the rank promotion exam when they fully meet the following standards and conditions:

a) Graded in quality at the level of completing tasks well or better in the working year immediately preceding the year of taking the promotion exam; have good political and moral qualities; not within the time limit for disciplinary action, not during the implementation of regulations related to discipline specified in Article 82 of the Law on Cadres and Civil Servants as amended and supplemented in Clause 17, Article 1 of the Amending Law, Supplementing a number of articles of the Law on Cadres and Civil Servants and the Law on Public Employees;

b) Have the capacity, professional qualifications and skills to assume a job position corresponding to a civil servant rank higher than the civil servant rank currently held in the same professional field;

c) Meet the requirements for diplomas, certificates and other requirements for professional standards of the exam category;

In case a civil servant has a professional diploma with an output standard in foreign language or information technology according to regulations that corresponds to the requirements of the exam category, they will meet the requirements on foreign language and information technology standards of the exam category. 

In cases where civil servants are exempted from taking foreign language or computer science tests according to the provisions of Clauses 6 and 7, Article 37 of this Decree, they must meet the requirements on foreign language and computer science standards of the exam category.

d) Meet the minimum working time requirements for each civil servant rank specified in the professional standards of the exam rank;

In case a civil servant, before being recruited or accepted, has worked for a period of time and paid compulsory social insurance in accordance with the provisions of the Social Insurance Law, working in a position requiring professional qualifications. Appropriate professional subjects (if the working time is not continuous without receiving a one-time social insurance benefit, it will be accumulated) and that time is calculated by the competent authority as a basis for salary ranking, the civil servant rank currently held is considered equivalent to the civil servant rank currently held.

In case there is an equivalent time, there must be at least 01 year (full 12 months) holding the lower rank adjacent to the exam rank until the deadline for submitting the application to register for the rank promotion exam.

4. The civil servant management agency is responsible before the law for the standards and conditions of civil servants appointed to participate in the rank promotion exam and to store and manage civil servant rank promotion exam registration documents according to provisions of the law.

According to this Article, civil servants who want to register for the rank promotion exam must meet the conditions as prescribed above in Vietnam.
