Can workers at factories near the Cambodia border be issued with a laissez-passer to go to work?

Article 4 of Decree 76/2020/ND-CP stipulates the issuance of laissez-passer as follows:

Article 4. Entities eligible for issuance of a laissez-passer

1. Entities eligible for the Vietnam-Cambodia border laissez-passer include officials and public employees, workers currently working in agencies, organizations, and enterprises headquartered in provinces sharing a border with Cambodia who are assigned to cross-border provinces in Cambodia for work.

2. Entities eligible for the Vietnam-Laos border laissez-passer:

a) Vietnamese citizens with permanent residence in provinces sharing a border with Laos;

b) Vietnamese citizens without permanent residence in provinces sharing a border with Laos but working in agencies, organizations, and enterprises headquartered in provinces sharing a border with Laos.

Thus, based on current regulations, if you are a worker at a factory located at the Vietnam-Cambodia border, you will be issued a laissez-passer to go to work.

Is it permitted to authorize the submission of a laissez-passer application?

Article 6 of Decree 76/2020/ND-CP stipulates the authorization for the submission of a laissez-passer application as follows:

1. Individuals working in lawful agencies, organizations, or enterprises can authorize their agency, organization, or enterprise to submit the application and receive results on their behalf.

2. In cases where enterprises are authorized to submit laissez-passer applications, before submission, the enterprise must send to the laissez-passer-issuing authority a legal entity dossier, including:

a) A certified copy or a verified photocopy of the enterprise's establishment decision or business registration certificate; if the photocopy is not verified, the original must be presented for verification;

b) An introduction letter specifying the sample seal and signature of the legal representative of the enterprise.

3. The submission of the legal entity dossier mentioned in Clause 2 of this Article is only conducted once; when there are changes to the dossier content, the enterprise must send a supplementary document.

Therefore, depending on specific cases, the applicant for a laissez-passer can authorize another individual or organization to perform the task on their behalf.
