Pursuant to Article 49 of Regulation 69-QD/TW in 2022, there are provisions as follows:

1. Party members who violate one of the following cases and cause less serious consequences will be disciplined in the form of reprimand:

a) Know but cause the wife (husband), child, father, mother, brother, sister, in-laws living in the same family to gamble, carry out money laundering activities, lend or borrow illegally in any form without taking preventive measures or not promptly reporting to competent state agencies.

b) Know but let parents, spouses, and children living in the same family use or store, circulate, buy, sell, or transport cultural products with prohibited or harmful content; military weapons, equipment, and other support tools contrary to regulations without promptly reporting to competent state agencies.

2. In case you have been disciplined according to Clause 1 of this Article but commit a repeat violation or the first violation causes serious consequences or violate one of the following cases, the disciplinary action will be in the form of a warning or dismissal:

a) Gambling or using drugs or participating in other social evils.

b) People who have the responsibility to directly fight and prevent social evils but tolerate, cover up, assist, ignore or fail to promptly handle violators (buying sex, selling sex, using drugs, gambling, borrowing, lending illegally or storing, circulating, trading, transporting, using cultural products with prohibited or harmful content).

c) Storing, circulating, trading, transporting, and using cultural products with prohibited or harmful content.

d) Tolerating, harboring or due to lack of responsibility allowing illegal prostitution, gambling, buying and selling or use of drugs and other social evils in the units, agencies, organizations, and areas under their direct management and responsibility.

d) Know but let your father, mother, wife (husband), child, brother, sister or relative or your spouse living in the same family to use, produce, store, buy and sell, transport drugs.

3. In case of violation of Clauses 1 and 2 of this Article causing very serious consequences or violating one of the following cases, discipline will be in the form of expulsion:

a) Organizing the production, sale, circulation or distribution of cultural products with prohibited or harmful content.

b) Illegally producing, storing, trading, transporting or organizing the illegal use of narcotics.

c) Using illegal debt collection practices in any form.

d) Organizations that harbor and broker prostitution; organizing prostitution activities; patronizing prostitution; taking advantage of service business to engage in prostitution.

d) Conspiracy, initiation, organization of gambling in any form or have been punished for gambling but continue to repeat the offense.

According to the regulations above, if you know that your child is gambling, but you still allow your child to gamble, you will be disciplined. The form of discipline will depend on the consequences caused.

What is the maximum imprisonment sentence for gambling in Vietnam?

Pursuant to Article 321 of the Criminal Code in 2015 (amended by Clause 120 Article 1 of the Law on amendments to the Criminal Code in 2017) stipulating illegal gambling as follows:

1. A person who illegally gambles in any shape or form with the stakes (in cash or kind) assessed at from VND 5,000,000 to under VND 50,000,000, or under VND 5,000,000 despite the fact that he/she has incurred an administrative penalty for the same offence or any of the offences specified in Article 322 hereof or has an unspent conviction for the same offence or any of the offences specified in Article 322 hereof shall be liable to a fine of from VND 20,000,000 to VND 100,000,000, face a penalty of up to 03 year's community sentence or 06 - 36 months' imprisonment.

2. This offence committed in any of the following circumstances carries a penalty of 03 - 07 years' imprisonment:

a) The offence is committed in a professional manner;

b) The stake is assessed at VND ≥ 50,000,000;

c) The offence is committed using the Internet, a computer network, telecommunications network or electronic device;

d) Dangerous recidivism.

3. The offender might also be liable to a fine of from VND 10,000,000 to VND 50,000,000.

As regulations above, the maximum imprisonment sentence for gambling is up to 07 years' imprisonment.
