Do Militia and Self-Defense Forces Belong to the Commune-Level Military Command?
At Clause 1, Article 20 of the 2019 Militia and Self-Defense Law, there is a stipulation:
The Commune-level Military Command is the standing body for defense work at the commune level. The composition of the Commune-level Military Command includes:
- The Commander is a Member of the Commune People's Committee, a reserve officer; in a state of national defense emergency, wartime, he is called into active service according to the regulations of the Vietnam People's Army Officer Law and continues to hold the position of Commander of the Commune-level Military Command;
- The Political Commissar is undertaken by the Secretary of the Commune-level Party Committee;
- The Deputy Political Commissar is undertaken by the Secretary of the Ho Chi Minh Communist Youth Union at the commune level;
- The Deputy Commander is a non-specialized activist at the commune level.
=> Thus, according to the above regulations, the militia and self-defense force are not part of the Commune-level Military Command. The Commune-level Military Command consists of the Commander, Political Commissar, Deputy Political Commissar, and Deputy Commander.
