In Article 1, Circular 13/2019/TT-BNV, amended by Article 1, Circular 04/2022/TT-BNV, stipulates standards of commune-level civil servants as follows:
1. Commune-level civil servants must meet the general standards specified in Article 3 of Decree No. 112/2011/ND-CP dated December 5, 2011 of the Government on civil servants of communes, wards and towns (hereinafter referred to as abbreviated as Decree No. 112/2011/ND-CP) and specific standards are as follows:
a) Age: 18 years old or older;
b) General education level: Graduated from high school;
c) Professional qualifications: Graduated from university or higher in a field of training suitable to the task requirements of each commune-level civil servant position, unless otherwise prescribed by law, the People's Committee at the level of province specifically regulates standards for professional qualifications from intermediate level or higher for civil servants working in communes: mountainous areas, highland areas, border areas, islands, island communes, remote areas, Ethnic minority areas and areas with particularly difficult socio-economic conditions.
d) Information technology proficiency: Be granted a certificate in using information technology according to basic information technology use skills standards specified in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 of the Ministry Information and communication.
2. Based on the standards of commune-level civil servants specified in Clause 1 of this Article and the actual conditions of the locality, the Provincial People's Committee decides:
a) The training field is suitable to the task requirements of each commune-level civil servant position in each recruitment period;
b) Develop training and fostering plans for each commune-level civil servant position on state management and political theory; foreign languages, ethnic minority languages (for work areas, ethnic minority languages must be used in public service activities).
3. The provisions in Decree No. 34/2019/ND-CP and this Circular are the basis for Provincial and District People's Committees to organize the implementation of planning, source generation, training, fostering, recruiting, implementing regimes and policies or downsizing staff. For civil servants recruited before this Circular takes effect but do not meet the standards prescribed in Clause 1 of this Article, within 5 years from the effective date of this Circular, they must meet the requirements specified in Clause 1 of this Article.
Thus, according to the above regulations in Vietnam, commune-level civil servants are not required to have an English degree in general regulations. Therefore, you may not need to have an English degree when working as a Commune justice and civil status civil servant. However, it depends on the specific regulations of each locality.
What are duties of Commune justice and civil status civil servants in Vietnam?
In Clause 6, Article 2, Circular 13/2019/TT-BNV, duties of commune justice and civil status officers are as follows:
a) Advise and assist the Commune-level People's Committee in organizing and implementing the tasks and powers of the Commune-level People's Committee in the fields of Justice and civil status in the area according to the provisions of law.
b) Directly perform the following tasks:
Disseminate and educate the law; Managing legal bookshelves, building communes that meet legal access standards; organizations serving the people in legal research; monitor law enforcement and organize consultation with people at commune level in participating in law making;
Inspect and review legal documents of the People's Council and Commune People's Committee and report to competent authorities for consideration and decision; Participate in civil judgment enforcement work in the area;
Carrying out tasks of judicial work, civil status, authentication, certification and monitoring of nationality and adoption; quantity and quality of population in the commune-level area according to the provisions of law; Coordinate with Social and Cultural officials to guide the construction of village regulations and conventions in villages, residential groups and educational work in the area;
Preside and coordinate with other civil servants to carry out conciliation work at the grassroots level; handle administrative violations, help commune-level People's Committees build and manage civil status databases in the area;
c) Perform other tasks as prescribed by specialized laws and assigned by the Chairman of the People's Committee at the commune level.
According to this Article, Commune justice and civil status civil servants will have the duties as prescribed above in Vietnam.
