Dismissal of the Chairman of the District People's Committee when appointed as Deputy Director of the Department of Home Affairs?
According to Clause 2, Article 13 of Decree 08/2016/ND-CP, the regulation on cases of dismissal of the Chairman of the District People's Committee is as follows:
- Resignation;
- Assigned to other work by a competent authority that does not fall under the regulation of mobilization as stipulated in Clause 1, Article 124 of the Law on Organization of Local Government;
- A competent authority decides on retirement or resignation;
- Not trusted as per the provisions of Clause 3, Article 89 of the Law on Organization of Local Government.
Therefore, if Mr. An, Chairman of the District People's Committee, is appointed by the province to be Deputy Director of the Department of Internal Affairs, without mobilization by the Chairman of the Provincial People's Committee, Mr. A will be dismissed according to the regulations.
If the mobilization is done as per the decision of the Chairman of the Provincial People's Committee, Mr. A will not be dismissed.
