Disciplinary Action for Communist Party Members Violating Regulations on Marriage with Foreigners According to Previous Regulations
Pursuant to Article 8 of Regulation 94/QD-TW of 2007 on the handling of disciplinary actions against Communist Party members who commit violations, issued by the Politburo, the content is stipulated as follows:
1- Violation of any of the following cases, causing minor consequences, shall result in disciplinary measures in the form of a reprimand:
a) Having a child marry a foreigner or a Vietnamese residing abroad without reporting honestly in writing to their cell, the standing committee of the Party managing unit about the background, political attitudes of the child’s spouse and their biological parents.
b) Having a child marry a foreigner in violation of the laws on marriage and family of Vietnam.
2- In cases where the violation has been subjected to disciplinary action under Clause 1 of this Article but re-offends, or violates any of the following cases, disciplinary measures shall be in the form of a warning or dismissal (if holding a position):
a) Having a child marry a foreigner or a Vietnamese residing abroad who acts against the Communist Party of Vietnam and the Socialist Republic of Vietnam.
b) Having a foreign wife or husband, or a Vietnamese residing abroad but not reporting to the organization.
c) Engaging in conduct forcing a child to marry a foreigner or a Vietnamese residing abroad for exploitative purposes.
d) Marrying a foreigner or a Vietnamese residing abroad but not reporting to the directly managing Party committee and the Party committee where they participate.
3- In cases of violating the provisions in Clause 1 and Clause 2 of this Article, if already subjected to disciplinary action and still re-offend causing very serious consequences, or violate one of the following cases, disciplinary measures will be in the form of expulsion:
a) Marrying a foreigner or a Vietnamese residing abroad who does not meet the conditions for marriage under Vietnamese law.
b) Marrying a foreigner or a Vietnamese residing abroad who engages in serious criminal activities, or has attitudes or activities against the Communist Party of Vietnam, the Socialist Republic of Vietnam.
c) Marrying a foreigner or a Vietnamese residing abroad without reporting in writing to the cell about related background information of the person the member marries, or has reported but the competent Party committee disapproved.
d) Intentionally concealing from the Party organization; agreeing, encouraging a child's marriage to a foreigner or a Vietnamese residing abroad in contravention of the Communist Party's regulations and the laws of the State.
