Construction and Confirmation of Dossiers of Officials and Public Employees of the Ministry of Justice

The construction and verification of personnel files for officials and public employees of the Ministry of Justice are regulated as follows: What are the procedures for supplementing and amending information in the personnel files of officials and public employees of the Ministry of Justice?

Construction and Verification of Officials and Public Employees Files of the Ministry of Justice

Pursuant to Article 13 of the Regulation on the Management of Officials and Public Employees and Laborers' Files issued together with Decision 1818/QD-BTP in 2020, the construction and verification of officials and public employees files of the Ministry of Justice are regulated as follows:

  1. Within 30 days from the date of the initial recruitment decision or signing of the labor contract, the competent agency or unit managing the officials and public employees files as specified in Articles 6, 7, 8, and 9 of this Regulation shall guide officials and public employees in declaring and completing their original files in accordance with Article 11 of this Regulation; organize the verification and verification of the truthfulness of the information declared by officials and public employees; cross-reference with the recruitment files and the judicial resume issued by the Department of Justice of the place of permanent residence. In case the components of the files have consistent information, they will be confirmed, stamped, and put under management.

  2. In the case of missing original file components or if there are no original files, the construction and completion of officials and public employees files shall be implemented as prescribed in points a and b, clause 4, Article 9 of Circular No. 11/2012/TT-BNV; clause 5, Article 10 of Circular No. 07/2019/TT-BNV.

Amendment and Supplementation of Information in Officials and Public Employees Files of the Ministry of Justice

According to Article 14 of this Regulation, policies on the amendment and supplementation of information in officials and public employees files of the Ministry of Justice are as follows:

  1. Periodic Addition of Officials and Public Employees Files

Annually, before December 31 or upon request of the competent authority, the heads of units under the Ministry shall guide officials and public employees to declare and supplement files in accordance with clause 1, Article 11 of Circular No. 11/2012/TT-BNV; clause 1, Article 12 of Circular No. 07/2019/TT-BNV.

  1. Re-establishment of Files due to Damage or Loss

In case of discovering that officials and public employees files are damaged or lost, the agency managing the files of officials and public employees is responsible for notifying in writing the agency using officials and public employees to guide them in declaring and completing the file components as regulated in clauses 1 and 2, Article 1 of Circular No. 06/2019/TT-BNV dated June 1, 2019, by the Minister of Home Affairs amending and supplementing certain articles of Circular No. 11/2012/TT-BNV (hereinafter referred to as Circular No. 06/2019/TT-BNV) and clause 3, Article 12 of Circular No. 07/2019/TT-BNV.

The results of the verification and inspection of the new files must be documented and reported to the head of the officials and public employees management agency for consideration and decision.
