Conditions for Recognizing Law-Approaching Status of Communes, Wards, and Commune-Level Towns

Pursuant to Article 4 of Decision 25/2021/QD-TTg stipulating the conditions for recognizing a commune, ward, commune-level town as meeting legal access standards as follows:
A commune, ward, commune-level town is recognized as meeting legal access standards when the following conditions are met:
The total score of the criteria is 80 points or more;
The total score of each criterion reaches 50% of the maximum score or more;
In the evaluation year, there are no officials who are heads of the Party Committee, government of the commune, ward, commune-level town (hereinafter referred to as commune level) who have been administratively disciplined for legal violations in performing their duties or have been prosecuted for criminal liability.
Procedure for Evaluating and Recognizing a Commune, Ward, Commune-level Town as Meeting Legal Access Standards
According to Article 5 of Decision 25/2021/QD-TTg stipulating the procedure for evaluating and recognizing a commune, ward, commune-level town as meeting legal access standards as follows:
The evaluation and recognition of a commune, ward, commune-level town as meeting legal access standards are conducted annually, from January 1 to December 31 of the evaluation year.
The commune-level People's Committee self-assesses, evaluates the results of the criteria and indicators; publicly post the results of self-assessment and evaluation; and submit the dossier proposing the recognition of the commune, ward, commune-level town as meeting legal access standards to the district-level People's Committee before January 10 of the year following the evaluation year.
The district-level People's Committee establishes a Council to evaluate legal access standards to advise and appraise, assisting the Chairman of the same level People's Committee in considering, deciding, recognizing, and announcing the commune, ward, commune-level town as meeting legal access standards on the district-level electronic information portal (or website) before February 10 of the year following the evaluation year.
The dossier proposing the recognition of the commune, ward, commune-level town as meeting legal access standards includes:
a) Report evaluating the results of meeting legal access standards;
b) Summary of scores for the criteria and indicators;
c) Summary, receipt, and explanation of opinions of organizations and individuals on the self-assessment and scoring of criteria and indicators (if any);
d) Written proposal for the recognition of the commune, ward, commune-level town as meeting legal access standards;
e) Other related documents (if any).
