Conditions for an early salary increase according to current Vietnamese regulations
I have achieved the title of Grassroots-Level Emulation Fighter for 3 consecutive years in 2017-2018, 2018-2019, 2019-2020. In August 2020, I received a salary increase on time. So may I ask if I will be considered for an early salary increase.

According to Clause 1a, Article 3, Circular 08/2013/TT-BNV regulating the regime of an early salary increase due to excellent achievements in performing tasks:
- Conditions and entitlements: The subjects specified in Clause 1 Article 1 of this Circular meet the 02 criteria specified in Clause 2 Article 2 of this Circular and achieve outstanding performance in performing tasks as decided by the competent authority in a written recognition, if not yet at the final salary grade in the salary regime or in the title and as of December 31 of the year of an early salary increase review, if there are less than 12 months remaining to be eligible for regular salary increase, they shall be considered for early salary increase up to a maximum of 12 months earlier than the time specified in Point a Clause 1 Article 2 of this Circular.
Therefore, the conditions for an early salary increase are:
- Being evaluated by the competent authority from the level of task completion and above;
- Not violating discipline in any form of reprimand, warning, dismissal.
- Not yet at the final salary grade in the salary regime or in the title;
- From the date of retirement notification until the retirement date, if there are less than 12 months remaining to be eligible for regular salary increase as prescribed.
- As of December 31 of the year of early salary increase review, if there are less than 12 months remaining to be eligible for regular salary increase, they shall be considered for early salary increase up to a maximum of 12 months earlier than the time specified in Point a Clause 1 Article 2 of this Circular.
Referring to Point a, Clause 1, Article 2 of this Circular stipulating the time to hold at titles for regular salary increase review:
- For the title of senior expert: If not yet at the final salary grade in the senior expert salary table, after 5 years (60 months) at the salary grade in the senior expert salary table, they shall be considered for a salary grade increment;
- For positions and titles requiring training from college level and above: If not yet at the final salary grade in the regime or in the title, after 3 years (36 months) at the salary grade in the regime or in the title, they shall be considered for a salary grade increment;
- For positions and titles requiring training from intermediate level and below and serving staff, employees: If not yet at the final salary grade in the regime or in the title, after 2 years (24 months) at the salary grade in the regime or in the title, they shall be considered for a salary grade increment.
Therefore, in your case, you have achieved the title of Grassroots-Level Emulation Fighter for 3 consecutive years and in August 2020, you were granted a salary increase on time. Since your case does not mention whether your salary level is already at the final level in the regime or title, if you meet the above conditions, you are still eligible for an early salary increase.
