Authority for financial management and budget administration of the Minister of Justice in financial management and public assets in Vietnam

Pursuant to Clause 1, Article 4, Regulations on decentralization and authorization of financial management, public assets, procurement of goods and services, investment in information technology application and public investment issued together with Decision 496 /QD-BTP 2022 has regulations on the financial management and budget management authority of the Minister of Justice in financial management, public assets, procurement of goods and services, investment in information technology applications and public investment are as follows:

a) Promulgate and specify mechanisms, policies, regimes and norms issued by competent State management agencies in the field of finance and budget for consistent implementation within the Ministry Justice;

b) Decide to allocate estimates, assign estimates, adjust state budget revenue and expenditure estimates for estimate units under the Ministry of Justice;

c) Decide on a plan to use financial sources to carry out the tasks of the Ministry of Justice;

d) Decide on the classification of public service units and autonomy plans for public service units under the management of the Ministry according to the provisions of law;

d) Decide to promulgate economic and technical norms for public services using state budget funds managed by the Ministry of Justice;

e) Report to the competent authority according to the provisions of law on budget with the following contents:

- Report on annual budget revenue and expenditure estimates; 3-year financial and state budget plan of the Ministry of Justice;

- Report to the Ministry of Finance on summarizing the results of allocation and assignment of annual state budget estimates of the Ministry of Justice;

- Financial reports, annual state budget revenue and expenditure settlement reports of the Ministry of Justice.

g) The Minister authorizes the Deputy Minister in charge of the unit:

- Report and propose competent authorities to promulgate or agree on standards, norms, and additional estimates of tasks of the units in charge;

- Decide on a plan to regulate civil judgment enforcement fees after receiving the Minister's opinion on expenditure tasks from the fee reconciliation source.

Pursuant to Clause 2 of Article 4, Regulations on decentralization and authorization of financial management, public assets, procurement of goods and services, investment in information technology application and public investment issued together with Decision 496 /QD-BTP 2022, the financial management and budget administration authority of the Director of the Department of Planning and Finance of the Ministry of Justice in financial management, public assets, procurement of goods and services, and application investment Information technology application and public investment are as follows:

a) The Minister authorizes the Director of the Department of Planning and Finance.

- Report to the Ministry of Finance on the synthesis of assigned estimates, adjustments and supplements of the estimate units under the Ministry of Justice to check estimate allocation and approve estimates on the Budget Management Information System and treasury (Tabmis);

- Report on the implementation of state budget revenue and expenditure estimates of the Ministry of Justice (quarterly);

- Report on the implementation of public annual budget of the Ministry of Justice (annual state budget estimates and settlement);

- Decide to publicize the estimates and settlement of annual state budget revenues and expenditures of the Ministry of Justice; Adjusted and supplemented estimates have been assigned by competent authorities to estimate units under the Ministry of Justice;

- Other reports of the Ministry of Justice according to the provisions of budget law.

b) The Minister delegates to the Director of the Department of Planning and Finance:

- Issue documents providing professional guidance in the field of financial management and accounting;

- Announcement of annual state budget revenue and expenditure estimates; 3-year state budget expenditure ceiling for budget units under the Ministry of Justice;

- Notify allocation details, assign annual budget revenue and expenditure estimates, adjusted and supplemented estimates to the estimate units under the Ministry of Justice;

- Update and exploit information on assigned estimates and adjusted estimates for units under the Ministry on the Budget and Treasury Management Information System (Tabmis);

- Organize the review, appraisal and notification of results of review and appraisal of the annual settlement of state budget revenues and expenditures to the estimation units under the Ministry of Justice; synthesize and prepare financial reports and annual state budget settlement reports of the Ministry of Justice;

- Organize inspection of compliance with regulations on financial management of estimate units under the Ministry of Justice according to the provisions of law and decentralization of the Ministry.
