Civil Servants Seconded to Extremely Disadvantaged Areas: Which Unit is Responsible for the Initial Allowance Payment?
Clause 5, Article 36, Law on Public Employees 2010 stipulates:
Public employees seconded to mountainous areas, border areas, islands, remote areas, areas with ethnic minorities, or areas with particularly difficult socio-economic conditions are entitled to support policies as prescribed by the Government of Vietnam.
To be specific: In this case, the public employee will enjoy support policies as stipulated in Decree 76/2019/ND-CP, which includes first-time allowances when appointed to work in areas with particularly difficult socio-economic conditions.
Point b, Clause 2, Article 15 of Decree 76/2019/ND-CP stipulates the responsibility for payment of the policy as follows:
For the first-time allowance for taking up duties in areas with particularly difficult socio-economic conditions, the agency, organization, or unit receiving the individual for duty pays the allowance. In case of secondment, the agency, organization, or unit that seconds the individual pays the allowance.
Therefore, if a public employee is seconded to an area with particularly difficult conditions, the first-time allowance for taking up duties there will be paid by the agency, organization, or unit that seconds the employee according to regulations.
