Circular 8 on Guidance for the Adjustment of Monthly Allowance for Retired Commune, Ward, and Commune-Level Town Officials in Poor Health

There has been Circular 8 guiding the adjustment of monthly subsidies for elderly commune-level officers who have retired?

On July 5, 2024, the Minister of Home Affairs issued Circular 8/2024/TT-BNV guiding the adjustment of monthly subsidies for elderly commune-level officers who have retired.

Circular 8/2024/TT-BNV applies to elderly commune-level officers who have retired and are receiving monthly subsidies under Decision 130-CP of 1975 and Decision 111-HDQT of 1981.

Circular 8/2024/TT-BNV takes effect from July 5, 2024, and simultaneously replaces Circular 11/2023/TT-BNV guiding the adjustment of monthly subsidies for elderly commune-level officers who have retired.

Section 3, Article 2 of Circular 8/2024/TT-BNV stipulates that retired elderly commune-level officers include: Former Party Secretaries, Chairpersons of the People's Committees, Vice Secretary, Vice Chairpersons, members of the standing Communist Party, secretaries of the People’s Committees, secretaries of the People’s Councils, village militia commanders, heads of commune public security, and other positions receiving a monthly subsidy of 3,500,000 VND/month from July 1, 2024.

When will the increase in monthly subsidies for elderly commune-level officers who have retired be implemented?

Based on Article 4 of Circular 8/2024/TT-BNV, the effective date is stipulated:

Effective Implementation

  1. This Circular takes effect from July 5, 2024.

  2. The regimes stipulated in this Circular are implemented from July 1, 2024.

  3. This Circular replaces Circular 11/2023/TT-BNV of the Minister of Home Affairs, dated August 1, 2023, guiding the adjustment of monthly subsidies for elderly commune-level officers who have retired.

During the implementation, if there are any difficulties, propose the relevant Ministries, sectors, and localities to report to the Ministry of Home Affairs for consideration and resolution.

Thus, the increase in monthly subsidies for elderly commune-level officers who have retired will be implemented from July 1, 2024.

How are the monthly subsidies for elderly commune-level officers who have retired adjusted?

Based on Article 2 of Circular 8/2024/TT-BNV, the monthly subsidies are adjusted as follows:

Adjustment of Monthly Subsidies

From July 1, 2024, implement the adjustment of monthly subsidies for retired elderly commune-level officers as prescribed in Article 2 of Decree 75/2024/ND-CP, dated June 30, 2024, of the Government of Vietnam, adjusting pensions, social insurance benefits, and monthly subsidies as follows:

  1. Increase by 15% the monthly subsidy over the subsidy received as of June 2024 for the subjects stipulated in Article 1 of this Circular.

The monthly subsidy received from July 1, 2024, is calculated by the formula:

Monthly subsidy received from July 1, 2024 = Subsidy received as of June 2024 x 1.15

Where: The subsidy received as of June 2024 is the subsidy stipulated in Section 3, Article 2 of Circular 11/2023/TT-BNV, dated August 1, 2023, of the Minister of Home Affairs, guiding the adjustment of monthly subsidies for elderly commune-level officers who have retired.

Thus, the monthly subsidy for elderly commune-level officers who have retired is adjusted as follows:

[1] Increase by 15% the monthly subsidy over the subsidy received as of June 2024.

The subsidy received from July 1, 2024, is calculated by the following formula:

Subsidy received from July 1, 2024 = Subsidy received as of June 2024 x 1.15

Where, the subsidy received as of June 2024 is as follows:

- For former Party Secretaries, Chairpersons of the People's Committees, Vice Secretary, Vice Chairpersons, members of the standing Communist Party, secretaries of the People’s Committees, secretaries of the People’s Councils, village militia commanders, heads of commune public security: 3,000,000 VND/month;

- For the remaining positions: 2,817,000 VND/month.

[2] From July 1, 2024, after adjusting the monthly subsidy for retired elderly commune-level officers, if the subsidy is less than 3,500,000 VND/month, it will be further adjusted as follows:

- Increase by 300,000 VND/person/month for those whose monthly subsidy is below 3,200,000 VND/person/month.

- Increase to 3,500,000 VND/person/month for those whose monthly subsidy ranges from 3,200,000 VND/person/month to less than 3,500,000 VND/person/month.
