Change of Residence of Martyrs' Worshipers: Is it Necessary to Transfer the Records of Persons with Meritorious Services?
Does the person worshiping the martyr need to relocate the file of the person with meritorious services when moving?
Pursuant to Clause 1, Article 49 of Circular 05/2013/TT-BLDTBXH, the scenarios for relocating the file of a person with meritorious services are stipulated as follows:
- The person with meritorious services or the person worshiping the martyr changes their place of residence;
- The relatives of the person with meritorious services who are receiving monthly preferential allowances when changing their place of residence may relocate the original file to the new place of residence, provided that there are no other relatives receiving monthly preferential allowances in the locality managing the original file.
In cases where there are still other relatives of the person with meritorious services receiving monthly preferential allowances in the locality managing the original file, a copy of the file shall be relocated.
Therefore, in your case, as the person worshiping the martyr, when you change your residence, you will need to relocate the file of the person with meritorious services.
Dossier and procedures for relocating the file of the person with meritorious services
The dossier and procedures for relocating the file of the person with meritorious services are regulated in Clauses 2 and 3 of this Article as follows:
- Dossier for relocation:
+ Application for dossier relocation (Form HS6);
+ A copy of the household registration book or long-term temporary residence book;
+ Dossier relocation notification form (Form HS7);
+ File to enjoy preferential policies.
- Relocation procedures:
+ Departure place:
The individual submits an application for dossier relocation to the Department of Labor, Invalids and Social Affairs where the dossier is managed, accompanied by a copy of the household registration book or temporary residence book.The Department of Labor, Invalids and Social Affairs, within 15 days from the date of receipt of the application, is responsible for checking, completing the relocation dossier, and sending it via registered mail to the Department of Labor, Invalids and Social Affairs where the individual resides; sending 01 dossier relocation notification form to the Department of People with Meritorious Services for monitoring and management; and 01 notification form to the individual for acknowledgment.
+ Destination place:
The Department of Labor, Invalids and Social Affairs receiving the dossier, within 10 days from the date of receipt, is responsible for:Informing the Department of Labor, Invalids and Social Affairs of the departure place.Checking the received dossier, if conformable, registering the subject for management and continuing to implement preferential policies as regulated.If the dossier is unsatisfactory, returning the dossier with an official document stating the reasons for not accepting and requesting the place transferring the dossier to check and supplement.
