Cases in Which Teachers Are Not Eligible for Regular Salary Increases
Translation:
At Clause 5, Article 1 of Circular 03/2021/TT-BNV, it is stipulated:
During the period of holding the current salary grade, if officials and public employees and workers have been notified or have a written decision from the competent authority that they did not complete the assigned tasks annually or were disciplined by one of the forms of reprimand, warning, demotion, dismissal, the period for regular salary grade increase will be extended compared to the period stipulated at Point a, Clause 1 of this Article as follows:
- Extended by 12 months for public employees and workers who are disciplined by dismissal.
- Extended by 06 months for the following cases:
+ Public employees who are disciplined by warning;
+ Officials and public employees and workers evaluated and classified by the competent authority as not completing the assigned tasks annually; in case during the grade period there are 02 non-consecutive years of not completing the assigned tasks, each year of not completing the assigned tasks will be extended by 06 months.
- Extended by 03 months for public employees who are disciplined by reprimand.
- In case of both being evaluated and classified as not completing the assigned tasks and being disciplined, the period for regular salary grade increase will be the total of the extended periods according to the above regulations.
- In case of being evaluated and classified as not completing the tasks due to being disciplined (for the same violation), the period for regular salary grade increase will be calculated according to the corresponding disciplinary form as stipulated above.
- In case officials and public employees and workers are Communist Party members disciplined by the Communist Party: if there has been a decision for administrative discipline, the extension period for regular salary grade increase will follow the administrative disciplinary form. If there is no administrative disciplinary decision, the extension period will follow the Communist Party disciplinary form corresponding to the administrative disciplinary forms stipulated in this clause.
