Can the District Police Examine the Management and Use of Explosives by Enterprises?
Based on the provisions stipulated in Article 24 of Circular 16/2018/TT-BCA, the inspection of the management and usage of weapons, explosives, and supporting tools is divided into periodic inspections and ad-hoc inspections.
Authority is determined as follows:
- Periodic inspections: The Department of Administrative Management on Social Order Police has the authority to inspect the management and use of weapons, explosives, and supporting tools for agencies, organizations, and enterprises as specified in Clauses 1, 2, and 3 of Article 3 of this Circular. The Provincial Department of Administrative Management on Social Order Police has the authority to inspect the management and use of weapons, explosives, and supporting tools for agencies, organizations, and enterprises as specified in Clauses 2 and 3 of Article 3 of this Circular.
- Ad-hoc inspections: The head of the police agency authorized for periodic inspections as mentioned above decides on the formation of an ad-hoc inspection team or assigns officers to carry out an ad-hoc inspection upon detecting any legal violations or receiving complaints and accusations related to the management and use of weapons, explosives, or supporting tools, or based on the requirements of ensuring security and order.
Thus, according to this regulation, periodic and ad-hoc inspections of the management and use of weapons, explosives, and supporting tools by enterprises are conducted by the provincial police agency or higher. The district-level police agency does not have this authority.
