Can officials in regions with particularly difficult socio-economic conditions sign indefinite-term contracts?

Are public employees working in areas with especially difficult socio-economic conditions allowed to sign indefinite-term contracts?

According to Clause 2, Article 2 of the Law on Cadres, Officials and the amended Law on Public Employees 2019, the types of working contracts are stipulated as follows:

  1. A fixed-term working contract is a contract where both parties determine the duration and the time of contract termination, which ranges from 12 months to 60 months.

    Fixed-term working contracts apply to individuals recruited as public employees from July 1, 2020, except for cases stipulated in points b and c, Clause 2 of this Article.

  2. An indefinite-term working contract is a contract where both parties do not determine the duration and the time of contract termination. Indefinite-term working contracts apply to the following cases:

    a) Public employees recruited before July 1, 2020;

    b) Cadres and officials transitioning to public employee positions as stipulated in point b, Clause 1, Article 58 of this Law;

    c) Individuals recruited as public employees working in areas with especially difficult socio-economic conditions.

  3. The Government of Vietnam stipulates the details of this Article.

Thus, according to the above regulations, if you are a public employee working in areas with especially difficult socio-economic conditions, you are allowed to sign indefinite-term working contracts.

Do public employees need to serve a probation period?

According to Article 27 of the Law on Public Employees 2010, the probation policies for public employees are stipulated as follows:

  1. Individuals who pass the recruitment for public employee positions must serve a probation period, except for those who have had 12 months or more of professional and specialized work experience relevant to the job position they are recruited for.

  2. The probation period ranges from 03 months to 12 months and must be stipulated in the working contract.

  3. The Government of Vietnam stipulates the details of the probation policies.

Therefore, you are required to serve a probation period when you pass the recruitment for a public employee position, except if you have had 12 months or more of professional and specialized work experience relevant to the job position you are recruited for.
