Pursuant to Article 12 of the Circular 13/2019/TT-BNV stipulating non-professional staff at the commune level as follows:
1. Based on paragraph 2 of Article 14 of Decree No. 92/2009/ND-CP as amended and supplemented at Clause 5, Article 2 of Decree No. 34/2019/ND-CP and the financial capacity of the locality (from the source of salary reform policy and the local budget), the People's Committee of the province shall submit to the People's Council of the same level to regulate in detail the following contents:
a) The positions of non-professional staff at the commune level;
b) The number of non-professional staff at the commune level shall be equal to or lower than the regulations at Clause 4, Article 2 of Decree No. 34/2019/ND-CP;
c) Specific regulations on the level of allowance for each position, the level of allowance for holding multiple positions for non-professional staff at the commune level;
d) Specific regulations on the level of budget funding for the operation of political and social organizations at the commune level in accordance with the actual situation of the locality.
2. The regulations on the regimes, standards, and norms for non-professional staff at the commune level, in addition to the funding regulations stipulated at Clause 1, Article 14 of Decree No. 92/2009/ND-CP as amended and supplemented at Clause 5, Article 2 of Decree No. 34/2019/ND-CP, shall be submitted by the People's Committee of the province to the People's Council of the same level for consideration and decision in accordance with the regulations at Clause 3, Article 21 of Decree No. 163/2016/ND-CP dated December 21, 2016 of the Government on detailed implementation of some articles of the State Budget Law.
3. Non-professional staff at the commune level are allowed to hold multiple positions of non-professional staff at the commune level.

What is the allowance paid to non-professional staff in the village in Vietnam?
Pursuant to Article 13 of the Circular 13/2019/TT-BNV stipulating non-professional staff in the village as follows:
1. The state budget shall implement the lump-sum allowance fund equivalent to 3 times the basic salary to pay monthly for non-professional staff in each hamlet or residential quarter. For the following hamlets, the lump-sum allowance fund shall be equal to 5 times the basic salary:
a) Hamlets with 350 households or more:
b) Hamlets in key and complicated areas in terms of security and order as decided by the competent authority:
c) Hamlets in border or island communes.
2. The regulations on the regimes, standards, and norms for non-professional staff; people directly participating in activities in hamlets or residential quarters, in addition to the funding regulations stipulated at Article 14a of Decree No. 92/2009/ND-CP as amended and supplemented at Clause 6, Article 2 of Decree No. 34/2019/ND-CP, shall be submitted by the People's Committee of the province to the People's Council of the same level for consideration and decision in accordance with the regulations at Clause 3, Article 21 of Decree No. 163/2016/ND-CP dated December 21, 2016 of the Government on detailed implementation of some articles of the State Budget Law.
As regulations above, non-professional staff in hamlets and residential quarters are entitled to an allowance of 3 times the basic salary to be paid monthly. However, for those special hamlets as prescribed above, non-professional staff will be entitled to an allowance of 5 times the basic salary.
Who determines the allowance for holding a non-professional position at the commune level in Vietnam?
Pursuant to Article 11 of the Circular 13/2019/TT-BNV stipulating as follows:
1. Only when the commune-level officials meet the conditions and standards of the commune-level civil servant positions prescribed in Decree No. 34/2019/ND-CP and this Circular can they be assigned to concurrently hold civil servant positions at the commune level.
2. The level of allowance for concurrent holding of positions for commune-level officials who meet the conditions for concurrent holding of positions prescribed in Clause 1, Article 10 of Decree No. 92/2009/ND-CP as amended and supplemented at Clause 3, Article 2 of Decree No. 34/2019/ND-CP is as follows:
a) A commune-level official who is currently ranked according to the position salary table and concurrently holds a commune-level position is entitled to a concurrent allowance of 50% of the first-level salary of the concurrent position.
b) A commune-level official who is currently ranked like a civil servant and receives a leadership allowance and concurrently holds a commune-level position is entitled to a concurrent allowance of 50% of the first-level salary of the civil service grade currently ranked plus the leadership allowance of the concurrent position.
c) A commune-level official who concurrently holds a commune-level civil servant position is entitled to a concurrent allowance of 50% of the first-level salary of the civil service grade currently ranked of the commune-level official being assigned to concurrently hold.
3. Commune-level officials and civil servants who concurrently hold the positions of non-professional staff at the commune level are entitled to concurrent allowances. The level of allowance for concurrent holding of the positions of non-professional staff at the commune level is regulated by the People's Committee of the province for consideration and decision by the People's Council of the same level.
