Can a Public Employee on Unpaid Leave for One Month in the Year Be Rated as Exceptionally Completing the Task?
In accordance with Article 12 of Decree 90/2020/ND-CP, the criteria for classifying public employees' performance as outstanding are as follows:
Public employees without managerial positions who meet all the following criteria are rated as outstanding in their job performance:
- Complying well with the regulations in Clauses 1, 2, 3, and 4 of Article 3 of this Decree;
- Completing 100% of tasks according to the signed employment contract, as per the set plans, or specific assigned tasks, ensuring timely progress, high quality, and high efficiency, of which at least 50% of the tasks exceed expectations.
Public employees in managerial positions who meet all the following criteria are rated as outstanding in their job performance:
- Complying well with the regulations in Clauses 1, 2, 3, 4, and Point a of Clause 5 of Article 3 of this Decree;
- All criteria for results in completing tasks according to the signed employment contract, as per the set plans, or specific assigned tasks are met on time, ensuring high quality and high efficiency;
- The unit or work area they are in charge of completes all targets and tasks, of which at least 50% of the targets and tasks exceed expectations;
- 100% of the units under their direct authority and management are evaluated as having completed their tasks or better, of which at least 70% are rated as good and excellent.
Regarding the criteria for demeanor and working style in Clause 3, it is stipulated:
+ Being responsible for the work; dynamic, creative, daring to think, daring to do, and flexible in carrying out tasks;
+ Having a scientific, democratic, and principled working method;
+ Possessing a sense of responsibility and coordination in task execution;
+ Maintaining proper attitudes and manners, standardized working styles that meet the requirements of public service culture.
=> Thus, according to the above regulations, public employees who take a one-month unpaid leave in a year can still be classified as outstanding in job performance if they meet the stated criteria.
