Can a person with a 2 degree degree be exempted from military service? I'm 26 years old, my right eye is 2 degrees nearsighted, am I exempt from military service? In case I am still called into military service, can I appeal?

Reply:

According to Clause 2, Article 41 of the 2015 Military Service Law, these following citizens shall have conscription exempted:

a) Any citizen who is a child of revolutionary martyrs or grade 1 wounded soldiers;

b) Any citizen who is a brother of revolutionary martyrs;

c) Any citizen who is a child of grade 2 wounded soldiers; a child of sick soldiers suffering labor capacity reduction of 81% or above; a child of people infected with dioxin and suffering labor capacity reduction of 81% or above;

d) Any citizen carrying out essential tasks who is not a soldier or a People’s Army;

dd) Any citizen who is official or youth volunteer assigned to extremely disadvantaged socio-economic area according to the law provisions for 24 months or more;

Thus, nearsightedness is not exempt from military service in Vietnam.

According to Clauses 1 and 3, Article 4, Circular 148/2018/TT-BQP stipulates military recruitment standards as follows:

1. Age:

a) Citizens from the age of 18 to under 26.

b) Graduate male citizen who enters university or college and postpones conscription for a training course of a level will be drafted until he turns 28.

2. Political requirements:

a) Comply with Joint Circular No. 50/2016/TTLT-BQP-BCA dated April 15, 2016 of the Minister of National Defense – the Minister of Public Security on provisions for political requirements for conscripting citizens into the Vietnamese People’s Army.

b) Drafting for crucial and classified agencies, units and positions in the Army; ceremonial battalion; professional National Guards and Military shall comply with regulations and law of the Ministry of National Defense.

3. Health requirements:

a) Draft citizens with health type 1, 2, 3 as specified in Joint Circular No. 16/2016/TTLT-BYT-BQP dated June 30, 2016 of the Minister of Health – the Minister of National Defense on provisions for pre-enlistment check-up.

b) Drafting for agencies, units and positions specified in Point b Clause 2 of this Article must ensure separate standards as regulated by the Ministry of National Defense.

c) Do not conscript citizens with health type 3 and eye disorders (1.5 dioptre myopia or higher, hypermetropia at all degrees); drug addicts, those contracted with HIV, AIDS.

4. Cultural requirements:

a) Draft citizens who finished 8th grade or higher in descending order. In areas where the drafting quota cannot be guaranteed due to hardship, request the competent authorities to consider and decide to draft citizens who finished 7th grade.

b) Communes in remote and isolated areas, in areas with economic - social hardships according to regulations and law; ethnic minorities below 10,000 people shall draft no more than 25% of the citizens who finished primary education and the citizens who finished lower secondary education are drafted to fill the rest.

If you are not a male citizen who has been trained at a college or university level and has been temporarily deferred from military service during a training course of a training level, then you will be recruited and called into the military until the end of 27 years of age. You have passed the prescribed military enlistment age.

In case you are close to 2 degrees, you will not be called into military service according to the provisions of Point c, Clause 3 of this Article.

In case you are over the prescribed age or have had a medical examination and have confirmed that you were not called up for military service due to being close to 2 degrees but are still called up for military service, you can complain to the Chairman of the Commune People's Committee to be resolved according to the provisions of the 2015 Military Service Law in Vietnam.

Pursuant to Clause 5, Article 39 of the 2015 Military Service Law, one of the tasks of the Commune-level Military Service Council is stipulated as follows:

5. Assist Presidents of the People’s Committees of communes to consider and decide the complaints and denunciations in the implementation of the law provisions on military service.

According to the information you provide, you can file a complaint with the commune-level Military Service Council where you participated in the military service medical examination for consideration and resolution in Vietnam.

Clause 2, Article 23 of the 2015 Military Service Law stipulates performance of non-commissioned officers/enlisted soldiers with professional knowledge as follows:

2. If a non-commissioned officer/enlisted soldier who has completed military service in regular armed force or is serving in reserve force and satisfies the requirements of the army volunteers (and the army has demand), such officer/soldier shall be transferred to serve as an army commissioned officer, a professional soldier or a defense official according to the law provisions.

Thus, after the end of her active duty service period, if you volunteered and the army had a need, you were recruited to serve under the regime of a professional soldier according to the provisions of law in Vietnam.
