Can a Deputy Head over 45 Years Old be Appointed to the Position of Head?
Pursuant to Clause 3, Article 6 of Decision 27/2003/QD-TTg which stipulates the appointment age for leadership officials as follows:
- For the first-time appointment, officials must not be over 55 years old for men and not over 50 years old for women;
- Specifically, for the positions of department head, deputy department head of districts, and equivalent, the first-time appointment age must not exceed 45 years old (for both men and women);

According to Article 2 of the aforementioned regulation, "First time appointment" refers to the case where the head of the competent authority decides for the first time to appoint officials to hold a leadership position or decides to appoint officials to a new higher leadership position than the current one.
=> Therefore, a person holding the position of Deputy Department Head being appointed to a higher leadership position (Department Head) is still considered as a first-time appointment. Hence, a person over 45 years old holding the position of Deputy Department Head is not eligible for the first-time appointment to the position of Department Head.
