Can a Communist Party Member Be Expelled for Cohabiting with a Girlfriend?
According to Clause 3, Article 24 of Regulation 102-QD/TW in 2017, the regulations are as follows:
In cases of violations specified in Clause 1 and Clause 2 of this Article that cause very serious consequences or violate one of the following cases, disciplinary action will be taken in the form of expulsion:
- Violation of regulations prohibiting marriage, violation of the one-wife, one-husband marriage policy.

Currently, in the Law on Marriage and Family 2014, there is no regulation that states two single people living together (cohabitation) without registering for marriage is an illegal act. It only prohibits the act of "A person who is married but marries or lives as husband and wife with another person, or a person who is not married but marries or lives as husband and wife with a married person;" (Point c, Clause 2, Article 5 of the Law on Marriage and Family 2014).
Based on the above regulation, if your niece’s girlfriend and your niece are both single, they will not violate the above policy and will not be disciplined by the Communist Party if discovered.
However, if one of them is already married and they still live together, your niece can be expelled from the Communist Party.
