Can a commander who has a university degree in addition to a military specialty get a salary increase to a university degree in Vietnam? After graduation, how long does it take for a deputy commander of commune-level military command to be transferred to a district-level civil servant in Vietnam? In what cases will a person stop holding his position in the commune-level military command in Vietnam?

In 2017, I graduated from University of Electrical Engineering Technology. From March 2018 to now, I have been appointed as the Chief Commander of the Commune Military Command, salary coefficient 1.86. So in my case before appointing the title of Commander of the Commune Military Command with a salary coefficient of 1.86. I have a university degree majoring in Electrical Engineering Technology, can I get a salary increase to a university degree?

In Article 17 of the Joint Circular 01/2013/TTLT-BNV-BQP stipulating the appointment of the Commander in Chief, according to which:

1. Conditions for consideration and appointment

In the planning category, the title of Commander in Chief; have a diploma of professional intermediate level in the grassroots military sector or higher.

2. Common standards

a) Comply with the provisions of Article 3 of Decree No. 112/2011/ND-CP dated December 5, 2011 of the Government on civil servants in communes, wards and townships;

b) Ensure the standards specified in Clause 1, Article 2 and the capacity to perform the tasks specified in Article 4 of the Circular No. 06/2012/TT-BNV dated October 30, 2012 of the Ministry of Home Affairs providing guidance on specific responsibilities, standards, tasks and recruitment of civil servants in communes, wards and townships.

3. Specific criteria for the Commander in Chief:

a) Have a diploma of professional intermediate level in the grassroots military branch or higher;

b) Have the capacity to advise the Party committees and People's Committees of communes to promulgate documents leading and directing the organization of national defense work, militia and self-defense work, and national defense and security education. and civil defense; building the all-people national defense and the people's security posture in the communes;

c) Effectively advise the Party committees and administrations of communes in leading and directing the implementation of regimes and policies towards the militia and self-defense forces, reserve and mobilization, policies on the rear of the army.

d) Formulate and organize the completion of defense and military tasks at commune level.

4. Authority to appoint

The President of the People's Committee of the district shall decide to appoint the Commander of the Military Command of the commune at the request of the Chairman of the People's Committee of the commune after reaching agreement with the Commander of the Military Command of the district.

As such, you have an undergraduate degree in Electrical Engineering Technology in Vietnam, unrelated to your current job title. Therefore, when appointed to the position of commander of the Commune Military Command, you are only entitled to a university salary when you have a university degree in a relevant discipline.

Therefore, your case is not transferred salary increase to a university degree in Vietnam.

After graduation, how long does it take for a deputy commander of commune-level military command to be transferred to a district-level civil servant in Vietnam?

Pursuant to Article 19 of the Joint Circular 01/2013/TTLT-BNV-BQP stipulating the use of post-training, according to which:

1. Incumbent commanders and deputy commanders of commune-level military commands having graduated from professional intermediate level, college or university with a grassroots military major, are assigned the correct position and title by the district-level People's Committee before being sent for training.

In case the Commander of the Military Command, due to work requirements, needs to be appointed the Commander of another commune-level Military Command in the same district, the Department of Home Affairs shall discuss and reach an agreement with the district-level military command and reported to the district-level People's Committee chairperson for decision.

2. After graduating from the training level, the commanders and deputy commanders of the commune-level military commands must have worked in the commune-level military command of full 03 years (36 months) or more before being assigned to other working positions or being transferred to the position of civil servant from the district level or higher, except for the case of being assigned to hold higher positions or titles or transferred from the old title to another commune-level administrative unit within the same district-level administrative unit.

3. Those trained from the source according to the planning of commanders and deputy commanders of the commune-level military commands after graduating from school will return to their localities to be assigned the right titles in the planning.

If it is not possible to arrange the correct titles according to the planning, the district-level military commands shall consider appointing them to the position of village captain, militia platoon leader or equivalent position of militia and self-defense commander.

With this regulation in Vietnam, you are the Commander of the Commune-level Military Command after graduating from training and must have worked in the Commune-level Military Command for full 03 years (36 months) or more before being assigned to other working positions or being transferred to the position of civil servant from the district level or higher.

Unless you are assigned to hold higher positions or titles or rotated in your old title to another commune-level administrative unit in the same district-level administrative unit in Vietnam.

In what cases will a person stop holding his position in the commune-level military command in Vietnam?

According to Article 20 of Joint Circular 01/2013/TTLT-BNV-BQP stipulating cases of resignation from the commune-level military command, as follows:

1. Not subject to the planning of cadres, civil servants and part-time workers at commune level.

2. According to legitimate wishes and has a resignation letter approved by the district-level People's Committee.

3. Have 2 consecutive years of being assessed by the competent authority at the level of “not completing the task”.

4. Failure to comply or submit to the organization's assignment.

5. Be disciplined in the form of demotion or dismissal.

6. During the time of being sent to training, he was disciplined and forced to drop out of school.

7. Retirement, retirement regime.

According to this Article, if you fall into one of the above cases in Vietnam, you will stop holding your position in the commune-level military command.
