Basis for assessment and quality ranking with persons representing state capital at enterprises managed by the Ministry of National Defense in Vietnam

What is basis for assessment and quality ranking of state capital representatives at enterprises managed by the Ministry of National Defense in Vietnam?

Pursuant to Article 7 of Circular 01/2022/TT-BQP (Effective from February 18, 2022) stipulating the basis, content, time of assessment and quality rating for capital contribution representatives state at enterprises managed by the Ministry of National Defense as follows:

- The basis, content, and time of quality assessment and grading for Managers, Controllers, and Representatives shall comply with the provisions of Articles 8, 10, 11 and 12 of Decree No. 159/2020 /ND-CP, Regulation No. 842-QD/QU dated August 6, 2018 of the Central Military Commission.

- Do not perform quality assessment and grading for Managers, Controllers, and Representatives in case of less than 06 consecutive months of work in the year of assessment.

Responsibility for assessment with persons representing state capital at enterprises managed by the Ministry of National Defense in Vietnam

Article 8 of Circular 01/2022/TT-BQP (Effective from February 18, 2022) stipulates assessment responsibilities of state capital representatives at enterprises managed by the Ministry of National Defense as follows:

- The company president is responsible to the Minister of National Defense or the Head of a unit under the Ministry of National Defense for the results of self-classification and assessment of Managers at his enterprise.

- The Department of Economics/Ministry of National Defense is responsible for the appraisal content and submits it to the Minister of National Defense to decide on the assessment of Managers, Controllers, and Representatives specified in Clause 1, Article 5 of this Circular. 

- The agency assigned to manage the enterprise at a unit under the Ministry of National Defense is responsible for the appraisal content and submits it to the Head of the unit under the Ministry of National Defense to decide on the assessment of managers and controllers specified in Clause 2, Article 5 of this Circular.

- Written assessment results are notified to Managers, Controllers, Representatives and direct management agencies.

Procedures for evaluation with persons representing state capital contributions are managed by the Ministry of National Defense in Vietnam

Procedures for evaluation with representatives representing state capital at enterprises managed by the Ministry of National Defense are specified in Article 9 of Circular 01/2022/TT-BQP (Effective from February 18, 2022) as follows:

- For Managers

The Chairman of the company organizes his own review and assessment of the quality of the Manager according to the provisions of Clause 1, Article 13 of Decree No. 159/2Q2Q/ND-CP and Articles 10, 11, 12 and 13 of this Circular, send the evaluation report with a self-comment, minutes of the manager's meeting and opinions of the Party Committee at the same level to the Department of Economics/Ministry of National Defense for the positions specified in Points a and b, Clause 1 Article 5 of this Circular, about units under the Ministry of National Defense for the positions specified in Point c, Clause 1 and Clause 2, Article 5 of this Circular.

- For Controllers

The Controller conducts the assessment according to the provisions of Clause 2, Article 13 of Decree No. 159/2020/ND-CP and Articles 10, 11, 12 and 13 of this Circular, and sends the assessment report along with a self-comment. about the Department of Economics/Ministry of National Defense for Controllers specified in Point b, Clause 1, Article 5 of this Circular, and about units under the Ministry of National Defense, for Controllers specified in Clause 2, Article 5 of this Circular.

- For Representatives

+ For enterprises in which the State holds more than 50% of charter capital: the Board of Directors or the Board of Members shall organize the review and assessment of the quality of the Representative according to the provisions of Clause 3, Article 13 of Decree No. 159/2020/ND-CP and Articles 10, 11, 12 and 13 of this Circular, send the assessment report along with self-comments, meeting minutes and opinions of the Party Committee at the same level to the Department of Economics/ Department of Defense;

+ For enterprises in which the State holds no more than 50% of charter capital:

The representative conducts the assessment according to the provisions of Clause 3, Article 13 of Decree No. 159/2020/ND-CP and Articles 10, 11, 12 and 13 of this Circular, and sends the assessment report along with a self-comment about the Department of Economics/Ministry of National Defense.

- Within 15 days from the date of receiving the complete written assessment for the Manager, Controller, and Representative as prescribed in Clauses 1, 2 and 3 of this Article, the Department of Economics/Ministry National Defense or the agency assigned to manage enterprises for units under the Ministry of National Defense shall preside over and coordinate with relevant agencies and units to appraise and draft documents assessing the level of task completion of Managers, Controllers and Representatives, submit to the competent authorities specified in Article 5 of this Circular for consideration and decision.

- Units affiliated to the Ministry of National Defense send an appraisal report accompanied by a self-assessment report, self-comments, minutes of the manager's meeting and opinions of the Party Committee at the same level of the enterprise under its management to the Department of Business. Department of Health/Ministry of National Defense for the positions specified in Point c, Clause 1, Article 5 of this Circular for appraisal before submitting to the Minister of National Defense for consideration and decision.

- Within 15 days from the date of signing the evaluation decision, the Head of the unit under the Ministry of National Defense, the President of the company shall send evaluation decisions of Managers, Controllers, and Representatives under their decision authority to the Department of Economics/Ministry of Defense for synthesis and supervision.
