Authority for Conferring, Promoting, Demoting, and Stripping of Ranks in the People's Public Security according to the New Law
On November 20, 2018, the National Assembly of the Socialist Republic of Vietnam, during its 14th tenure and at its 6th session, passed the People's Public Security Law No. 37/2018/QH14 (referred to as the 2018 People's Public Security Law).
The 2018 People's Public Security Law provides regulations on the principles of organization and operation; the position, functions, tasks, and powers; ensures conditions for activities, policies, and benefits concerning the People's Public Security; and the responsibilities of related agencies, organizations, and individuals.
According to the provisions in Article 26 of the 2018 People's Public Security Law (effective from July 1, 2019), the authority to promote, elevate, demote, and strip ranks; raise salaries for officers, non-commissioned officers, and soldiers; appoint, relieve, dismiss, and demote positions; appoint and relieve titles within the People's Public Security is specifically regulated as follows:
- The President awards and promotes the rank of general to officers of the People's Public Security.
- The Prime Minister of the Government of Vietnam appoints the position of Deputy Minister of Public Security; decides on salary raises for the rank of General and Senior General.
- The Minister of Public Security decides on salary raises for the ranks of Lieutenant General, Major General; regulates the promotion, elevation, and salary increases for other ranks, as well as the appointment of remaining positions and titles within the People's Public Security.
- The person with the authority to promote a certain rank has the authority to demote and strip that rank; each time only one rank level can be elevated or demoted, except in special cases where multiple rank levels are considered for elevation or demotion. The person with the authority to appoint a certain position has the authority to relieve, dismiss, and demote that position. The person with the authority to appoint a certain title has the authority to relieve that title.
