Assignment of individuals to perform state secret protection duties: What are the regulations?
According to the provisions of Article 7 of Decree 26/2020/ND-CP (Effective from July 1, 2020), the assignment of individuals to perform state secret protection tasks is stipulated as follows:
The Central Office and party committees; central agencies of political-social organizations; the Office of the National Assembly; the Office of the President; ministries, ministerial-level agencies, agencies affiliated with the Government of Vietnam; the Supreme People's Court, the Supreme People's Procuracy; the State Audit; the People's Committee of provinces and centrally-run cities are responsible for assigning individuals to perform specialized state secret protection tasks in the office or administrative, general units.
Units under, affiliated with the agencies and organizations specified in Clause 1 of this Article; the Provincial Party Committee, City Party Committee, Town Party Committee, and Provincial People's Council; the District Party Committee, District People's Council, and District People's Committee are responsible for assigning individuals to concurrently perform state secret protection tasks in the office or administrative, general units.
The assignment of individuals to specialized and concurrent state secret protection tasks in the armed forces and cryptography is carried out in accordance with the regulations of the Minister of National Defense and the Minister of Public Security.
Individuals performing specialized and concurrent state secret protection tasks must meet the following standards:
a) Possess good moral qualities, meet political standards, have legal and professional knowledge and expertise in protecting state secrets, and strictly comply with the policies, directions, and policies of the Communist Party and the laws of the State;
b) Be responsible for maintaining state secrets; comply with the assignment and mobilization of the agency, organization, and fully perform the assigned duties and responsibilities.
- Individuals performing specialized and concurrent state secret protection tasks are entitled to policies in accordance with the provisions of the law.
