Are Village Police Officers Entitled to Allowances?

I am a village police officer, am I entitled to allowances? Since taking the position from November 1, 2020, I have not received any allowances.

Based on the provisions in Article 10 of the Commune Police Ordinance 2008:

Commune police include the titles: Chief of Commune Police, Deputy Chief of Commune Police, and Commune Police Officer.

Commune Police Officers are stationed in hamlets, villages, neighborhood groups, and tasked with on-call duties at the commune police headquarters or other working locations of the commune police.

According to this regulation, a commune police officer is part of the commune police but does not hold the titles of Chief/Deputy Chief of Commune Police.

Article 18 of this Ordinance also stipulates:

The Deputy Chief of Commune Police and Commune Police Officers are entitled to a monthly allowance. The Government of Vietnam prescribes the framework of allowances for the Deputy Chief of Commune Police and Commune Police Officers. The Provincial People’s Committee, based on the regulations of the Government of Vietnam and local actualities, submits to the People's Council at the same level to decide the specific allowance.

Regarding allowance policies, according to the provisions in Article 3, Article 5 of Decree 92/2009/ND-CP:

The Chief of Commune Police is a commune-level official entitled to salary and allowances according to the regulations of the Government of Vietnam concerning policies for officials at communes, wards, and commune-level towns.

Meanwhile, the Deputy Chief of Commune Police and Commune Police Officers are non-specialized local officials entitled to allowance policies as prescribed in Clause 5, Article 2 of Decree 34/2019/ND-CP.

Non-specialized local officials are entitled to allowance policies, social insurance benefits, and health insurance benefits. The state budget provides a lump-sum allowance fund, including support for social insurance and health insurance, to make monthly payments to non-specialized local officials based on the categorization of administrative units at the commune level, ward, and commune-level town as follows:

- Category 1 receives a lump-sum allowance fund equivalent to 16.0 times the statutory pay rate;- Category 2 receives a lump-sum allowance fund equivalent to 13.7 times the statutory pay rate;- Category 3 receives a lump-sum allowance fund equivalent to 11.4 times the statutory pay rate.

Based on this lump-sum allowance fund, the Provincial People’s Committee submits to the People's Council at the same level to decide the specific number of non-specialized local officials (including commune police officers) and the allowance for each position.

Thus, combining the above regulations, in your case as a commune police officer in a hamlet, you are entitled to an allowance for non-specialized local officials; however, the specific allowance amount will depend on the decision of the Provincial People’s Council where you work. You can contact the Commune People’s Committee for more information on your allowance policies.
