Are results of consideration for promotion of public employees in management of students specialization preserved in Vietnam?

Pursuant to Article 18 of Circular 29/2022/TT-BLDTBXH, which stipulates bases and principles for organizing exams or considering promotion to public employees specialized in student management as follows:

1. The appointment of public employees specialized in managing trainees to participate in exams or consider for promotion to professional titles must be based on job positions, professional title standards and suitable to the structure of public employees according to professional titles of public non-business units approved by competent authorities.

2. Public employees specialized in student management may register for exams or consider for promotion to professional titles when the public non-business units have demand and fully satisfy the criteria and conditions as prescribed by law.

3. The organization of exams or consideration for promotion to professional titles of public employees specialized in student management must comply with the principles of equality, publicity, transparency, objectivity and lawfulness.

4. Exam results or consideration for promotion to professional titles of public employees specialized in student management may not be reserved for the next exams or promotion consideration.

As such, the results of consideration for promotion of professional public employees in management of students are not preserved in Vietnam.

What documents do I need to register for an exam or consider promotion to a public employee specialized in student management in Vietnam?

In Article 21 of Circular 29/2022/TT-BLDTBXH stipulating that the application for registration for examination or consideration for promotion to professional titles of public employees specialized in student management is specified:

1. Dossier of registration for examination or consideration for promotion to professional titles of public employees specialized in student management shall comply with the provisions of Article 36 of Decree No. 115/2020/ND-CP dated September 25, 2020 of the Government regulations on recruitment, employment and management of public employees.

2. For promotion exam: the form, content and time of the promotion exam for professional titles of public employees specialized in student management shall comply with the provisions of Article 39 of Decree No. 115/2020/ND-CP dated 25 September 2020 of the Government on recruitment, use and management of public employees.

According to this Article in Vietnam, it is necessary to prepare a dossier of registration for examination or consideration for public employee promotion, including:

- Curriculum vitae of public employees according to current regulations, within 30 days from the deadline for submitting applications for examination or consideration for promotion to public employees, certified by agencies or units employing public employees.

- A written comment and assessment of the head of the public non-business unit employing public employees or the head of the agency competent to manage the public non-business unit on the satisfaction of the criteria and conditions for registration to participate in the exam or consider for promotion to professional titles of public employees according to the provisions of Article 4 of this Circular.

- Decision on recruitment, decision on appointment to the professional title of public employee specialized in Information and Communication (or equivalent), decision on the latest salary increase.

- Copies of diplomas and certificates at the request of the professional title to be examed or considered for promotion. Specifically:

+ Professional diploma and certificate of professional training (if any) according to the regulations of each category of professional title;

+ Diploma in political theory as prescribed by each category of professional title (if any);

+ Certificate of training in professional title standards according to the regulations of each category of professional titles

- Copies of documents issued by competent authorities proving the satisfaction of standards of professional capacity and professional competence of the professional title to be contested or considered for promotion as prescribed. Specifically:

+ A decision or document of a competent person on assignment of the chairperson of a work recognized or awarded by the specialized arts and science council; preside over or participate in writing special topics in theoretical works, theoretical researches on specialized science and technology (ministerial and provincial levels);

+ Certificate of specialized arts and sciences council (if any) or award certificate;

+ Minutes of acceptance test of theoretical works, theoretical research on specialized science and technology (ministerial and provincial level).

+ Decision on commendation of competent authorities for public employees considering promotion to professional titles.

What is priority order in implementation of determination of successful candidates for promotion to professional title of administrator in Vietnam?

In Clause 2, Article 22 of Circular 29/2022/TT-BLDTBXH stipulating priority order in implementation of determination of successful candidates for promotion to professional title of administrator:

2. Determine the successful candidate in the promotion review

Officers who are selected for promotion in the promotion examination are public employees who fully satisfy the conditions and criteria specified in Clauses 1 and 2, Article 18 , Clause 2, Article 19 (for main student administrators), and Clause 2, Article 20 (for student administrators) this Circular and be recognized by the head of the agency or unit organizing the promotion consideration for the successful results in the promotion consideration period. In case there are 02 or more equal candidates in the final criterion, the determination of the successful candidates shall be made in the following order of priority:

a) Public employees with achievements and rewards of higher authorities;

b) The public employee is female;

c) Public employees are ethnic minorities;

d) The public employee is older (calculated by day, month and year of birth);

e) Public employees have more working time.

If the candidate still cannot be identified, the head of the agency or unit organizing the professional title promotion consideration shall issue a document to the head of the agency or unit managing public employees and decide on the recruited person at the request of the head of the agency or unit managing public employees.

Pursuant to the above provisions in Vietnam, in case there are 02 or more people who are equal in the final criterion, the determination of the successful candidate for promotion to the administrative professional title shall be carried out in the following order of priority:

- Public employeeswith achievements and rewards of higher authorities;

- Public employeesare female;

- Public employeesare ethnic minorities;

- The public employee is older (calculated by day, month, year of birth);

- Public employees have more working time.
