Pursuant to Clause 1 Article 22 of the Law on Public Employees in 2010 stipulating recruitment registration conditions as follows:
A person who meets all the following conditions, regardless of nationality, gender, social status, belief and religion, may register for public employee recruitment:
a/ Bearing Vietnamese citizenship and residing in Vietnam:
b/ Reaching full 18 years of age. For a number of areas of cultural activity, arts. physical training and spoils, the age eligible for recruitment may be lower as provided by law with written consent of at-law representatives:
c/ Filing an application for recruitment:
d/ Having a clear personal background;
e/ Possessing diplomas, training certificates or practice certificates or aptitude and skills relevant to the working position for which he/she applies:
f/ Being physically fit for work or tasks;
g/ Meeting other conditions required by the working position for which he/she applies and determined by the public non-business unit, which must not be contrary to law.
For public employees, only Vietnamese nationality and residing in Vietnam are required to participate in civil servant recruitment. When applying for public employee positions, there are also no regulations that require only one Vietnamese nationality. Therefore, civil servants can have two citizenships.

What public employee positions have a probationary period of only 3 months in Vietnam?
The current Civil Service Law stipulates a probationary period of from 3 months to 12 months and must be specified in the employment contract. Thus, what civil servant positions require a probationary period of only 3 months?
Answer:
Pursuant to Clause 2 Article 27 of the Law on Public Employees in 2010 stipulating as follows:
The probation period may last from 3 months to 12 months and must be stated in the working contract.
However, according to Clause 2, Article 21, Decree 115/2020/NĐ-CP, the probationary period is as follows:
- 12 months in case of recruitment to a professional position that requires university education standards. Particularly for the professional title of doctor, it is 9 months;
- 09 months for recruitment into professional positions that require college education standards;
- 06 months for recruitment into professional positions that require intermediate training standards.
Therefore, the shortest probationary period is 6 months for public employee positions that require a medium-level educational qualification. The current regulations also do not stipulate any public employee positions that require a probationary period of less than 6 months. Therefore, there is no case of a 3-month probationary period for public employees.

Answer:
Pursuant to Clause 5 Article 36 of the Law on Public Employees in 2010, secondees working in mountainous, border, island, deep-lying, remote, ethnic minority areas or areas with extremely difficult socio-economic conditions are entitled to support policies as stipulated by the Government.
Specifically, in this case, the public employees will be entitled to the support policies stipulated in Decree 76/2019/NĐ-CP, including the initial allowance when taking up a position in a region with special economic and social difficulties.
Point b, Clause 2, Article 15 of Decree 76/2019/NĐ-CP stipulates the responsibility for paying the policy as follows:
For the initial allowance for taking up a position in a region with special economic and social difficulties, the receiving agency, organization, or unit will pay. In the case of a detachment, the sending agency, organization, or unit will pay.
Therefore, for public employees who are assigned to a remote and difficult area, the initial allowance for taking up a position there will be paid by the sending agency, organization, or unit in accordance with the regulations.
