Are overseas Vietnamese eligible for an ID card of Vietnam?
Based on Article 19 of the Law on Identification 2023, which regulates the issuance of ID cards:
Article 19. Individuals granted ID cards
1. Individuals granted ID cards are Vietnamese citizens.
2. Vietnamese citizens aged 14 and over must undergo the procedure for obtaining an ID card.
3. Vietnamese citizens under 14 years old can be granted an ID card upon request.
According to Article 3 of the Law on Vietnamese Nationality 2008:
Article 3. Interpretation of terms
In this Law, the following terms are understood as follows:
1. Foreign nationality refers to the nationality of a country other than Vietnam.
2. Stateless person is someone who does not have Vietnamese nationality and also does not have foreign nationality.
3. Overseas Vietnamese are Vietnamese citizens and people of Vietnamese origin residing and living long-term abroad.
4. People of Vietnamese origin residing overseas are those who previously held Vietnamese nationality where their nationality was determined based on the principle of blood relations, and their descendants are residing and living long-term overseas.
5, Foreigners residing in Vietnam are foreign citizens and stateless individuals who are permanently or temporarily residing in Vietnam.
Based on the above provision, individuals granted ID cards are Vietnamese citizens.
Under current regulations, overseas Vietnamese include both Vietnamese citizens and people of Vietnamese origin residing and living long-term abroad. Furthermore, people of Vietnamese origin residing overseas are those who have previously held Vietnamese nationality.
Additionally, under Article 5 of the Law on Vietnamese Nationality 2008, individuals with Vietnamese nationality are considered Vietnamese citizens.
Therefore, overseas Vietnamese are still eligible for ID cards if they hold Vietnamese nationality.

What are the cases for replacement of ID cards?
Based on Article 24 of the Law on Identification 2023, which stipulates the cases for replacement and reissuance of ID cards in Vietnam:
Article 24. Cases for replacement and reissuance of ID cards
1. Cases for replacement of ID cards include:
a) Cases specified in Clause 1, Article 21 of this Law;
b) Change, rectification of information regarding surname, middle name, birth name; date, month, year of birth;
c) Change of appearance; supplementing information regarding facial photos, fingerprints; redefining gender, or changing gender in accordance with legal regulations;
d) Errors in printed information on the identification card;
dd) At the request of the cardholder when information on the ID card changes due to administrative unit rearrangement;
e) Reestablishment of personal identification number;
g) When the cardholder requests it.
2. Cases for reissuance of ID cards include:
a) Lost ID card or card damaged beyond use, except for cases specified in Article 21 of this Law;
b) Returning to Vietnamese nationality in accordance with the nationality law of Vietnam.
Hence, the cases for replacement of ID cards in Vietnam include:
- Vietnamese citizens who have been issued an ID card must undergo the replacement procedure at the ages of 14, 25, 40, and 60.
- Change, rectification of information regarding surname, middle name, birth name; date, month, year of birth
- Change of appearance; supplementing information regarding facial photos, fingerprints; redefining gender, or changing gender according to the provisions of law
- Errors in printed information on the ID card

Which acts are prohibited regarding identification in Vietnam?
Based on Article 7 of the Law on Identification 2023, the prohibited acts regarding identification include:
- Issuing, renewing, reissuing, or revoking ID cards, identification certificates contrary to the provisions of law.
- Retaining ID cards, identification certificates contrary to the provisions of law.
- Harassment, causing inconvenience, discrimination when processing administrative procedures related to identification, the National Database on Population, and the Identification Database.
- Falsifying records, files regarding identification, information in the National Database on Population and the Identification Database; failure to provide, providing incomplete, inaccurate information, or providing contrary to the provisions of law regarding identification or information in the National Database on Population, Identification Database.
- Not performing the procedure for issuing ID cards to Vietnamese citizens aged 14 and over.
- Producing, putting into use tools, means, software, or other acts causing obstruction, disturbance to the information infrastructure operations of the National Database on Population and the Identification Database, identification and electronic verification systems.
- Forging, modifying, intentionally altering ID card contents, electronic identification, identification certificates; seizing, using another's ID card, electronic identification, identification certificate illegally; renting, leasing, pawning, receiving pawn, destroying ID cards, identification certificates; using fake ID cards, electronic identification, identification certificates.
- Accessing, altering, deleting, destroying, spreading, or undertaking other activities related to processing personal data in the National Database on Population, Identification Database, identification and electronic verification systems contrary to the provisions of law.
- Exploiting, sharing, buying, selling, exchanging, seizing, using unauthorized information, data in the National Database on Population, Identification Database, identification and electronic verification systems.
