Are Homosexual Individuals Exempt from Military Service?
According to Clause 2, Article 5, Circular 148/2018/TT-BQP stipulating exemption from conscription for the following citizens:
- Children of martyrs, children of first-class war invalids.
- One brother or one sister of a martyr.
- One child of a second-class war invalid; one child of a person with a disability reducing work capacity by 81% or more; one child of a person affected by Agent Orange reducing work capacity by 81% or more.
- People engaged in cryptographic work who are not military personnel or People’s Public Security officers.
- Officials and public employees, youth volunteers assigned to work in areas with particularly difficult socio-economic conditions according to legal regulations for 24 months or more.
Thus, homosexuals do not belong to the cases exempt from performing military service. Because on your documents your gender is male, if you meet the conditions, you still have to perform military service according to regulations.
