Pursuant to Article 16 of the Law on Officers of the Vietnam People's Army 1999, amended by Clause 5, Article 1 of the Law on Officers of the Vietnam People's Army, amended in 2008, stipulates persons to be bestowed with ranks of on-active service officers:

Persons to be bestowed with ranks of on-active service officers

1. Cadets graduating from active-service officers training schools will be bestowed the rank of second lieutenant; those who graduate with excellent or good grade in peculiar disciplines or record outstanding achievements in work will be bestowed the rank of lieutenant, or in special cases, higher ranks as provided by the Minister of Defense.

2. Non-commissioned officers and soldiers during wartime; professional armymen and defense employees on active service; non-military officials and employees and university graduates or people of higher degrees, who join the army on active service and are appointed to hold posts of officers, will be bestowed the corresponding ranks of officers.

According to this Article, cadets graduating from active-service officers training schools are awarded the rank of active duty officer as follows:

- Cadets who graduate from active-service officers training schools will be bestowed the rank of second lieutenant;

- Cadets who graduate with excellent or good grade in peculiar disciplines or record outstanding achievements in work are bestowed the military rank of Lieutenant.

In addition, in special cases in Vietnam, higher ranks will be awarded according to regulations of the Minister of National Defense.

What leave benefits do on-active service officers in the Army have in Vietnam?

Pursuant to Article 3 of Circular 153/2017/TT-BQP regulating leave regimes for military officers:

On-active service officers' leave regimes

1. On-active service officers are entitled to the following leave benefits:

a) Annual leave;

b) Special leave;

c) Holidays and holidays;

d) Nursing leave;

d) Weekly leave;

e) Leave to prepare for retirement.

2. During the leave period as prescribed in Clause 1 of this Article, officers are entitled to full salary and allowances; be paid leave according to the provisions of Circular No. 13/2012/TT-BQP dated February 21, 2012 of the Ministry of National Defense stipulating the leave payment regime for salaried employees working in agencies, Army unit (hereinafter referred to as Circular No. 13/2012/TT-BQP).

Thus, on-active service officers are entitled to the following leave benefits:

- Annual leave;

- Special leave;

- Holidays and holidays;

- Rest and convalescence;

- Weekly leave;

- Leave and prepare for retirement.

During the prescribed leave period, on-active service officers are entitled to full salary and allowances; paid leave.

What are regulations on leave regimes for on-active service officers in Vietnam?

Annual leave regime prescribed in Article 4 of Circular 153/2017/TT-BQP:

- Officers are entitled to annual leave as follows:

+ Under 15 years of work are entitled to 20 days off;

+ From 15 years of service to less than 25 years of service, you are entitled to 25 days off;

+ From 25 years of work or more, you are entitled to 30 days off.

- Officers in military units stationed away from their families (spouses; biological children, legally adopted children; parents (both husband's and wife's sides); legal guardians) when on annual leave extra leave:

+ 10 days for the following cases: Stationed 500 km or more away from family; stationed in remote, remote or border areas 300 km or more away from family; stationed on the islands of the Truong Sa and DK archipelagos.

+ 05 days for the following cases: Stationed 300 km to less than 500 km away from family; stationed in remote, remote or border areas 200 km or more away from family and with an area coefficient of 0.5 or more; Stationed on islands are entitled to regional allowances.

- In cases where annual leave cannot be taken due to duty requirements, the following year the unit commander will consider and decide to allow subordinate officers to take leave to compensate for the previous year.

- In special cases, due to the unit's mission requirements, it is still not possible to arrange for officers to take leave, they will be paid salaries for days not taken on annual leave according to regulations.

- Travel time does not count towards annual leave days.

- Every year, commanders of units at regimental level and equivalent or higher, based on the unit's combat readiness, training and work tasks, make plans for officers to take leave more than 15% of the unit's total number of officers.

- Units that are not part of the combat readiness block, depending on the nature and requirements of the mission, will perform accordingly. Academies and schools mainly arrange leave for officers during the summer.

Special leave regime specified in Article 5 of Circular 153/2017/TT-BQP:

- In addition to the annual leave regime, officers are entitled to special leave of no more than 10 days at a time for the following cases:

+ Married officer; biological children and adopted children are legally married.

+ The family encounters unexpected difficulties due to parents, legal guardians (both husband and wife); wife or husband); biological or legally adopted children are seriously ill, have accidents, die, die or suffer from serious natural disasters.

Holidays and holidays prescribed in Article 6 of Circular 153/2017/TT-BQP:

- Every year, officers are entitled to holidays and New Year holidays according to the provisions of the Labor Code and the founding day of the Vietnam People's Army (December 22).

- For units performing combat readiness tasks, training or due to mission requirements, holidays will be decided by the commander of the regiment-level unit or equivalent or higher based on the situation of the unit's tasks, perform them appropriately.

Nursing leave regime prescribed in Article 7 of Circular 153/2017/TT-BQP:

Officers are allowed to rest and recuperate according to regulations.

Weekly leave prescribed in Article 8 of Circular 153/2017/TT-BQP:

- Every week, officers have Saturday and Sunday off.

- For units performing combat readiness tasks, training or due to mission requirements, weekly leave will be given by the commander of the unit at regimental level or equivalent or higher based on the situation of the unit's tasks, perform them appropriately.

Pre-retirement leave regime prescribed in Article 9 of Circular 153/2017/TT-BQP:

- If an officer decides to retire, the time off to prepare for his family is as follows:

+ From 20 years of work to less than 25 years of work, you are entitled to 09 months off;

+ From 25 years of work or more, you are entitled to 12 months off.

- In case an officer wishes to retire immediately (does not take time off to prepare for retirement or does not take enough leave to prepare for retirement), upon transfer, he or she will receive the difference in salary due to not taking time off to prepare for retirement according to current regulations.

- Officers who take time off to prepare for retirement at home must register their time off with the People's Committee of the commune, ward or town where the family resides.

- During the time off to prepare for retirement, if you suffer from a serious illness, illness requiring long-term treatment, or mental illness, comply with regulations on management, treatment, care, and settlement of policies for military personnel, defense workers, and people working in cipher organizations managed by the military with serious illnesses, illnesses requiring long-term treatment, and mental illnesses.
