On October 20, 2023, the Minister of Construction issued Circular 10/2023/TT-BXD guiding leadership and management job positions and specialized professional titles, and structure of civil servants by professional title in public service units in the construction industry and field.

According to this regulation, there are 16 leadership and management positions and specialized professional titles, and a structure of officials according to professional titles in public service units in the construction industry and field. Specifically includes:

What principles must be met when determining leadership and management positions and professional titles in public service units in the construction in Vietnam?

In Article 3 of Circular 10/2023/TT-BXD, there are regulations on principles and bases for determining leadership and management job positions and job positions with specialized construction titles in public service units in construction industry and field as follows:

Principles and bases for determining leadership and management job positions and job positions with professional construction titles in public service units in the construction industry and field

1. Principles for determining guaranteed job positions as prescribed in Article 3 of Decree No. 106/2020/ND-CP dated September 10, 2020 of the Government on job positions and number of people working in the application public service positions (hereinafter referred to as Decree No. 106/2020/ND-CP).

2. Basis for determining guaranteed employment positions as prescribed in Clause 1, Article 4 of Decree No. 106/2020/ND-CP.

Thus, determining leadership and management job positions and professional titles in public service units in the construction sector in Vietnam must meet the following principles:

- Strictly implement the Party's policies and the law on job positions, number of employees and streamlining staff in public service units.

- Consistent with the functions, tasks, powers and organizational structure of the public service unit.

- Ensure scientificity, objectivity, openness, transparency, efficiency and improve the quality of officials and workers in public service units.

- Ensure that a worker is assigned enough work to perform within the prescribed working time. Job positions that do not have enough workload to be performed within the prescribed time of one employee must be arranged part-time.

- Ensure a reasonable structure, in which the number of people working in specialized positions and shared professional titles accounts for at least 65% of the total number of people working in public service units.

What is basis for determining structure of public employees by professional title in public service units in the construction in Vietnam?

Article 6 of Circular 10/2023/TT-BXD stipulates structure of public employees by professional title as follows:

Structure of civil servants by professional title

Determining the structure of civil servants by professional title is carried out according to the provisions of Clause 5, Article 3, Clause 3, Article 4 of Decree No. 106/2020/ND-CP.

In Article 4 of Decree 106/2020/ND-CP, there are regulations on the basis for determining job positions, number of employees and structure of public employees by professional title as follows:

Basis for determining job positions, number of employees and structure of public employees by professional title

1. Basis for determining job position includes:

a) Functions, tasks, powers, organizational structure of public service units;

b) Complexity, nature, characteristics, and scale of operations; scope and objects of service; Professional and professional management processes according to specialized laws.

2. Bases for determining the number of workers include:

a) Job position and actual workload at each job position of the public service unit;

b) Level of modernization of offices, equipment, working facilities and application of information technology;

c) Current status of management and use of the number of assigned workers of the unit.

3. Basis for determining the structure of civil servants by professional title includes:

a) List of job positions;

b) The complexity of the job position;

c) Standards and professional titles of civil servants corresponding to the job position.

Thus, determining the structure of public employees by professional title in public service units in the construction sector will be based on the following bases:

- List of job positions.

- The complexity of the job position.

- Standards and professional titles of civil servants corresponding to job positions.

Note: Circular 10/2023/TT-BXD takes effect from December 5, 2023.
