When will the new land price list be announced in Vietnam under the Land Law 2024?

Pursuant to Article 159 of the Land Law 2024, the land price list is stipulated as follows:

Article 159. Land price list

2. The land price list is established by area and position. For areas with digital cadastral maps and land price databases, the land price list is established for each parcel based on a value range and standard parcel.

3. The People's Committees of a first-level administrative division shall make and submit a request to the People's Council at the same level to issue a decision on the first land price list for announcement and application from January 1, 2026. Every year, the People's Committee of the first-level administrative division shall submit a request to the People's Council at the same level to issue a decision to adjust, amend or supplement the land price list for announcement and application from January 1 of the following year.

In cases where it is necessary to adjust, amend, or supplement the land price list within the year, the provincial People's Committee is responsible for submitting the decision to the provincial People's Council.

The provincial land management agency is responsible for assisting the provincial People's Committee in organizing the establishment, adjustment, amendment, and supplementation of the land price list. During implementation, the provincial land management agency may hire a consulting organization to determine land prices for the establishment, adjustment, amendment, and supplementation of the land price list.

4. The Government of Vietnam shall detail this Article.

According to the Land Law 2024, the time for the announcement and application of the initial land price list in Vietnam is from January 1, 2026.

Annually, the provincial People's Committee is responsible for submitting adjustments, amendments, or supplements to the land price list to the provincial People's Council for decision-making to announce and apply from January 1 of the following year.

Note: The land price list issued by the provincial People's Committee under the Land Law 2013 continues to be applied until the end of December 31, 2025; if necessary, the provincial People's Committee decides to adjust the land price list according to this law to suit the actual land price situation in the locality. (as stipulated in Clause 1, Article 257 of the Land Law 2024)

According to Article 160 of the Land Law 2024, the specific land price is defined as follows:

Article 160. Specific land price

1. The specific land price is applied to the following cases:

a) Calculating the land levy for organizations when the State allocates land with land levy collection without auctioning land use rights, not auctioning investor selection for projects using land, allocating land with land levy collection for investors winning the bid or economic organizations established by winning investors to execute projects using land, recognizing land use rights, permitting the change of land use purpose that requires land levy payment;

b) Calculating land rent when the State leases land and collects land rent for the entire lease term, except through the auction of land use rights;

Thus, the specific land price applies to the following cases:

- Calculating the land levy for organizations when the State allocates land with land levy collection without auctioning land use rights, not auctioning investor selection for projects using land, allocating land with land levy collection for investors winning the bid or economic organizations established by winning investors to execute projects using land, recognizing land use rights, permitting the change of land use purpose that requires land levy payment

- Calculating land rent when the State leases land and collects land rent for the entire lease term, except through the auction of land use rights

- Calculating the value of land use rights when equitizing state-owned enterprises according to the equitization law

- Determining the starting price for auctioning land use rights when the State allocates land, leases land, except in cases of determining the starting price for auctioning land use rights when the State allocates land, leases land for land parcels or land zones that have been invested with infrastructure according to detailed construction planning

- Calculating land levy, land rent when extending land use, adjusting land use term, adjusting detailed construction planning; allowing the change of land use type

- Calculating compensation when the State recovers land.

Who are the members of the Councils for appraisal of land price lists in Vietnam?

According to Article 161 of the Land Law 2024, the Councils for appraisal of land price lists, Councils for appraisal of specific land prices are stipulated as follows:

  1. The provincial People's Committee decides to establish the Council for appraisal of land price lists comprising the Chair of the provincial People's Committee or one Vice Chair of the provincial People's Committee as the Chair of the Council, the Head of the provincial financial agency as Vice Chair of the Council, members of the provincial People's Committee being heads of provincial specialized agencies; district People's Committee Chairs; representatives of relevant agencies, consulting organizations determining land prices, and experts.
  1. The provincial People's Committee decides to establish the specific Council for appraisal of land price lists at the provincial level, which includes the Chair of the provincial People's Committee or one Vice Chair of the provincial People's Committee as the Chair of the Council; the Head of the provincial financial agency as Vice Chair of the Council; district and commune People's Committee Chairs where the land is located and representatives of relevant agencies and organizations. The provincial People's Committee may invite representatives from land price consulting organizations or land price experts to participate as members of the Council.

- Representatives of relevant agencies, consulting organizations determining land prices, and experts
