When will the Law on Land in 2024 in Vietnam be announced in full?
The Law on Land in 2014 is a legislative document that was recently passed during the extraordinary fifth session of the National Assembly at the beginning of 2024.
Pursuant to Article 80 of the Law on Promulgation of legislative documents in 2015 stipulating announcement of laws, ordinances, and resolutions as follows:
Announcement of laws, ordinances, and resolutions
1. The President shall announce a law or ordinance within 15 days from the day on which it is ratified.
In case the President requests Standing Committee of the National Assembly to consider an ordinance ratified by Standing Committee of the National Assembly as prescribed in Clause 1 Article 8 of the Constitution, the President shall send the written request to Standing Committee of the National Assembly within 10 days from the day on which the ordinance is ratified. Standing Committee of the National Assembly shall reconsider the issues raised by the President at the nearest meeting. After the ordinance is put on the vote and ratified again by Standing Committee of the National Assembly, the President shall announce it within 15 days from the day on which it is ratified again by Standing Committee of the National Assembly. If the President still disagrees, the President shall present the case to the National Assembly for decision at the nearest meeting.
The President shall announce a law or ordinance formulated and promulgated under simplified procedures within 05 days from the day on which it is ratified.
2. Secretary general of the National Assembly shall announce the resolution of the National Assembly, resolution of Standing Committee of the National Assembly within 15 days from the day on which it is ratified.

As regulations above, the time limit for announcement of laws is stipulated as follows:
[1] Laws formulated and promulgated under full procedures shall be announced within 15 days from the day on which they are ratified.
[2] Laws formulated and promulgated under simplified procedures shall be announced within 05 days from the day on which they are ratified.
The Law on Land in 2024 was recently approved by the National Assembly on January 18, 2024, and it was not promulgated under simplified procedures. Therefore, the expected deadline for announcement of the Law on Land in 2024 in full is no later than 15 days after January 18, 2024.

In his closing remarks of the extraordinary session of the National Assembly, the Chairman of the National Assembly emphasized that the promulgation of the amended Land Law at this session, along with the amended Housing Law and the amended Real Estate Business Law at the sixth session, had met the requirements of perfecting a synchronized policy and legal framework for land management and use in line with the socialist-oriented market economy development system, ensuring the most efficient, sustainable, and effective management, exploitation, and utilization of land resources.
The Chairman of the National Assembly also emphasized that this achievement was the result of close coordination, careful and scientific preparation, with early and remote efforts and high determination from the National Assembly Standing Committee, the Government, the Vietnam Fatherland Front, the National Assembly's agencies, deputies, and relevant organizations.
The Chairman of the National Assembly also requested the Government to allocate resources and promptly prepare the necessary conditions to ensure the issuance and implementation of specific plans to quickly integrate the Land Law into practice.

The Law on Land in 2024 will come into effect from January 1, 2025, except for Article 190 and Article 248 of the Law on Land in 2024, which will take effect from April 1, 2024.
What are changes on agricultural land in the Law on Land in 2024 in Vietnam?
The amended Land Law aims to enhance and improve the mechanisms and policies for managing and utilizing agricultural land by expanding the limit for receiving land use rights transfer in agriculture to no more than 15 times the local land allocation limit.
Additionally, the law expands the scope of recipients for transferring land use rights for rice cultivation to economic organizations and individuals who are not directly engaged in agricultural production. This provision aims to provide opportunities for organizations and individuals with financial and technical capabilities to access land and invest in agricultural production, while also addressing the issue of abandoned or inefficiently used agricultural land.
The Law on Land in 2024 also introduces provisions allowing agricultural land users to restructure their crop and livestock systems and use a portion of their land for constructing facilities directly serving agricultural production. Moreover, it permits agricultural land users to engage in commercial activities, services, livestock farming, or medicinal plant cultivation, but without altering the designated land use types as specified by regulations.
The amended Land Law strictly prohibits "improperly changing the purpose of land use without proper authority, outside the designated scope, or not in accordance with the approved annual land use plans at the district level." It also includes provisions for penalizing individuals who commit violations by allowing the improper change of land use purposes during the course of official duties.
To limit the conversion of agricultural land use purposes after transfer, the Law on Land in 2024 stipulates that organizations and individuals receiving agricultural land transfers must use the land for its designated purposes. In cases where the land is converted for non-agricultural purposes, it must be authorized by the competent state authority.
