What steps are required for the transfer of property ownership?
Pursuant to the Land Law 2013, Circular 156/2013/TT-BTC, and Decree 140/2016/ND-CP.
Clause 3, Article 188 of the Land Law 2013 stipulates:
The conversion, transfer, lease, sublease, inheritance, donation, mortgage of land use rights, and capital contribution by land use rights must be registered with the land registration office and shall be effective from the time of registration in the cadastral register.
To ensure that the transfer of real estate complies with the law, the parties need to follow these 03 steps:
Step 1: Notarize or authenticate the transfer contract;
Step 2: Declare personal income tax and registration fee;
Step 3: Submit the documents for title transfer (register the change).
When transferring real estate, the change must be registered within 30 days from the date the transfer contract takes effect.
