Article 66 of Decree 95/2020/ND-CP stipulates valuation of scientific background of individual consultant with one-stage, two packages method for procurement of bidding packages under the CPTPP Agreement, as follows:

1. After the terms of reference and the list of individual consultants are approved, the bid solicitor shall send an invitation letter and terms of reference to the individual consultants named on the list, clearly stating the deadline and location. Only scientific resumes are accepted.

2. Submit scientific curriculum vitae:

The individual consultant shall prepare the scientific curriculum vitae according to the requirements stated in the terms of reference and the technical proposal (if any) and submit it to the procuring entity according to the time and address in the invitation letter.

3. Evaluation of scientific resumes:

Based on the contents of the terms of reference, the bid solicitor evaluates the scientific résumé of each individual consultant. Individual consultants are eligible as prescribed in Clause 2, Article 6 of this Decree; having the best scientific resume and technical proposal (if any), meeting the requirements of the terms of reference will be invited by the bid solicitor to negotiate and finalize the contract.

4. Negotiate and finalize the contract.

The approval of individual consultant selection results must be made in writing and based on the written approval, report on the evaluation results of the individual consultants' scientific records, the results of legal negotiations. copper. The contract signed between the parties must be consistent with the decision approving the individual consultant selection results, the contract negotiation results and the content of the terms of reference.

According to Article 67 of Decree 95/2020/ND-CP stipulating preparation for stage one bidding in one-stage, two packages method for procurement of bidding packages under the CPTPP Agreement, as follows:

1. Based on the scale and nature of the bidding package, the short list selection procedure may be applied to select qualified and experienced contractors as required by the bidding package to invite to participate in the bidding. . The application of the short list selection procedure is decided by the competent person and must be clearly stated in the contractor selection plan; in the case of applying the short list selection procedure, the short list selection shall comply with the provisions of Article 46 of this Decree.

2. Preparation of bidding documents for stage one:

a) Bases for preparation of bidding documents as prescribed in Clause 1, Article 37 of this Decree;

b) The bidding dossier for stage one includes the following contents: Brief information about the project or bidding package; guide the preparation and submission of bids for the first stage; ideas and requirements on the technical plan of the bidding package; requirements on financial and commercial plans for contractors to propose technical plans, financial and commercial plans, as a basis for bid solicitors to consider and complete the second stage bidding documents; do not require contractors to propose bid prices and implement bid security measures.

The bidding documents must not state any conditions to limit the participation of contractors or to create advantages for one or several bidders, causing unfair competition; does not require a contractor who has entered into one or more contracts with a procuring agency of a particular country or territory, or that the contractor has experience in supplying goods or services within the country. such country or territory as the criterion for the exclusion of bidders.

3. Evaluation and approval of bidding documents:

a) Bidding documents must be appraised before approval;

b) The approval of the bidding dossier must be in writing and based on the report on approval, the report on appraisal of the bidding dossier.

What is stage one bidding organization in one-stage, two packages method for procurement of bidding packages under the CPTPP Agreement in Vietnam? 

Pursuant to Article 68 of Decree 95/2020/ND-CP stipulating stage one bidding organization in one-stage, two packages method for procurement of bidding packages under the CPTPP Agreement, according to which:

1. The bidding for stage one shall comply with the provisions of Clause 1, Article 49 of this Decree.

2. Issuing, amending and clarifying the bidding documents:

The issuance, modification and clarification of the bidding documents shall comply with the provisions of Clause 2, Article 38 of this Decree.

3. Preparing, submitting, receiving, managing, amending and withdrawing bids:

The preparation, submission, receipt, management, modification and withdrawal of bids shall comply with the provisions of Clause 3, Article 38 of this Decree.

4. Bidding opening:

a) The bid opening must be conducted publicly and begin within 01 hour from the time of bid closing. Only open bids received by the bid solicitor prior to the bid closing time as required by the bidding documents in the presence of the representatives of bidders attending the bid opening ceremony, regardless of the presence or absence of the bidders. the presence or absence of contractors;

b) Bid opening shall be conducted for each bid in alphabetical order of names of bidders and in the following order:

- Check sealing;

- Open the dossier and clearly read the information about: Name of contractor; the number of originals and photocopies of the dossier; main information stated in the bid form; validity period of bids; other relevant information;

c) Minutes of bid opening: The information mentioned at Point b of this Clause must be recorded in the record of bid opening. The bid opening minutes must be signed for certification by the representatives of the bid solicitor and the bidders participating in the bid opening. This record must be sent to the participating contractors;

d) The representative of the bid solicitor must sign for certification on the original bid application, the power of attorney of the legal representative of the contractor (if any); joint venture agreement (if any).

5. Discussion about the stage one bid:

During the evaluation of stage one bids, based on the requirements stated in the bidding documents and proposals of the contractors in the stage one bids, the bid solicitor shall discuss with each bidder in order to correct technical and financial requirements of the bidding package to serve the completion of the second stage of bidding documents. The bid solicitor must ensure that the information in the first stage bids of the bidders is not disclosed.
